New generation of judges cannot afford the ways of erstwhile generation. Now the risk , workload, accountability, pressure and responsibility has increased many fold  .
Security offered  an all the ways to at least judges at the ground level   ( I hate the word- subordinate ) has almost been taken away. The gaps between the hierarchy is increasing day by day and that too dangerously. I am worried.
This is more or less  everywhere.

जैसे ही मुझे तुम्हारी एक और कमजोरी का पता चल जाता है , मेरा आत्मविश्वास बढ़ जाता है। 

और जब तक तम्हारी कमजोरियाँ सामने नहीं आ पाती  है तो और तब तक  मै तुमसे घृणा ,ईर्ष्या करते हुए श्रद्धा का ढोंग करता हूँ क्यों की मैं तुमसे डरा हुआ होता हूँ। 

तुम्हारे और मेरे बीच यही दुरी है , यही डर है , और मैं स्वयं को महान बनाये रखने के लिये  यह दुरी , भ्रम बनाये रखना चाहता हूँ ताकि  मेरे बारे में सही सही तुम जान न जाओ। 

मैं तुम्हें कभी यह नहीं जानने दूंगा की मूलतः तुम और मैं एकदम से हू  बहू  हैं।
जीतनी भी और जैसी भी कमजोरियां तुममें है , वे सभी कमोबेस मेरे में भी हैं।
पर मैं तुम्हे य्ह् जानने  नहीं दूंगा , यदि तुम जान गये तो मेरी महानता खतरे में पड़ जाएगी !
मेरे प्रति सदा श्रद्धावनत रहो -चाहे किसी भी शर्त पर .

खुद के बंधन से खुद और खुदी को आजाद तो करो ,सब कुछ आजाद हो जायेगा ,कुछ भी बोझ नहीं रह जायेगा .
मैं मेरा भार  स्वयं हूँ और मैनें अपने आप को ही अपने से इस प्रकार बांध लिया है , की सब कुछ बंधा बंधा सा लगता है .बस मुझे अपने आप से ही अपने आप को मुक्त करवाना है .

ब्रांडेड आशीर्वाद से आशीर्वाद लेने वाले के चेहरे पर मुस्कराहट आ ही जाती है.

एक पिता के लिए अपनी संतानों का सुखद, मित्रवत और भरोसे भरा दांपत्य देखना उसके जीवन की सबसे अर्थवान उपलब्धियों में एक होती है।

मैं अपनी सम्पूर्ण यात्रा के दौरान यात्रा -पथ पर मील के पत्थर , आगे पीछे की दिशा दर्शक निशान तथा तय की गई दुरी का वर्णन , लिखते लिखाते , लगते ,लगाते  खोंसते ,गढ़ते चला आ रहा हूँ ताकि तुम्हे आगे कुछ कम तकलीफें हो ,

कुछ एक दिए भी जला छोड़े है जो कुछ समय तक अँधेरे में भी तुम्हारी मदद करेंगें , अपनी ताकत भर एक आधार -रचना भी खडी कर दी है की तुम बैचैन नहीं हो जाओ - अब बस तुम्हें आगे की यात्रा के लिये तैयार होना है .

मेरी यात्रा के जो अंश छिपाए जाने योग्य थे ,सार्वजनिक नहीं किये जाने चाहिए थे उन्हें भी मैनें साफ सभी को बता डाला है -आगे तुम्हें स्वविवेक से काम लेना होगा .

मैं यही कह सकता  हूँ की जीवन गुनते हुए सावधानी से चला ही भला,इसके बाद भी कुछ गलतियाँ हो ही जाती है ,उन पर अटक जाना ठीक नहीं ,न ही  हो गई भूलों से निराश होना है - बस चलते चलो -

पहले की पीढ़ियों से बेहतर चलने का प्रयास करना है ,आगे वाली पीढ़ियों के लिये चलना है - खुद को एक कड़ी के रूप में जीना है , पुल बनाते हुए , बनते हुए जीना है -चलना है .

हम किसी विचार को उसकी उपादेयता , प्रासंगिकता या तार्किकता से अधिक उस विचार का  श्रोत ,विचार का माध्यम  तथा विचार की पैकिंग के आधार पर क्यों देखते ,समझते हैं .
उच्च श्रेणी के उत्पाद की स्वीकार्यता उत्पाद के अपने गुण होने चाहिए ,
उसको पैदा करने वाला किसान ,उसे बेचने वाला व्यापारी अथवा वह खेत जिसमे वह उत्पाद पैदा हुआ है ,आदि की चर्चा निरर्थक है .

साफ सुथरा , सीधा ,मेहनती आदमी  झूठ फरेब ,दांव पेंच  को समझ ही नहीं पाता और कुटिल प्रवृत्ति के लोग या तो ऐसे लोगों का बखूबी इस्तेमाल कर लिया करते हैं।
यदि इस्तेमाल करने में मुश्किल पेश आती है तो उसे किनारे या ठिकाने लगा दिया जाता है।
कुटिलता सभी के बस की बात नहीं .
शिखर तक के रास्ते सीधे,साफ-सुथरे नहीं होते।
इन रास्तों तक तो पहुंचा जा सकता है पर इन रास्तों पर चल कर शिखर तक पहुंचाना सभी के बस की बात नहीं।
इन रास्तों पर चलने का अलग ही हुनर होता है।  कुटिलता का अपना ही व्याकरण है।

वह प्रिय हो या अप्रिय ,उचित हो या अनुचित ,नैतिक हो या अनुचित , शिखर तक पहुँचने का वह रास्ता है , वही एक रास्ता  है और उसे जानना ,सीखना चाहिए अन्यथा एक महत्वपूर्ण योग्य्ता से वंचित रह जायेंगें।
जो इस रास्ते नहीं चले वे किनारे लगते गये।

अपनों की गलतियाँ माफ़ कर देना अपनापन नहीं है , अपने आप को अपनों की गलतियों के लिये जिम्मेदार सनझ उसके दंड में स्वयं को भागीदार बना लेना ,उसका प्रायश्चित करना ही अपनापन हैं - हमारे पापों में से कितने पाप की सजा हमारे माता -पिता ने,: हमसे आपसे अधिक भोगी है ; और यही अपनापन है

मैं इमारती लकड़ियों का कोई पुराना पेड़ तो था नहीं कि तुम मुझे लकड़ियों के लिये काट ही डालते तब भी मैं तुम्हारे मशरफ का ही होता !
मैं नीम या अमरुद के पेड़ की नई टहनी भी तो नहीं की दतुवन के मशरफ के लिये मुझे तोड़ लेना ही जरुरी था।
मैं तो था फल फूल से लदा उपयोगी पेड़ जो अभी कई पीढियों तक तुम्हारे काम आएगा यह संकल्प मेरा था ।
तुम मुझे झुकाना चाहते थे ,अपने लालच के लिये।
मैं नहीं झुका और तुमने मुझे कहीं से तोड़ कर अपना आज का लालच पूरा किया।
हो सकता है एक बार फिर तुम ऐसा ही करो !
तुम्हारा उस बार भी लालच पूरा हो ही जाये !!
पर मैं जब जहाँ तोड़ोगे वहीं से फिर एक बार साँस लेने लगूंगा , अनंत नई कपोलों को निकालूँगा , फिर फ़ैल जाऊंगा - चारों और - झुंकुगा तो नहीं , नहीं भागूँगा , नहीं मिटूंगा - आगे बढ़ता ही रहूँगा -
आजतक कैसे बढ़ा हूँ ,कोई तुम्हारे भरोसे ?
आगे भी तुम्हारे भरोसे कभी  नहीं !!!!

इंसान बुरे वक्त से गुज़रने के बाद ही जीवन का महत्व समझ पाता है. बहुत छोटी उम्र में कड़वे अनुभव से आप बेहतर इंसान बनने की कोशिश भी करते हैं.अपनी जिंदगी में पॉजिटिव इफेक्ट डालने वाले इन कडवे अनुभवों से  आप स्वयं बात करने की कोशिश कर रहे  होते हैं. आप  अपने आस-पास के लोगों को सुनना शुरू कर देते है और आप जानते हैं कि चीजों में बदलाव लाने के लिए अभी देर नहीं हुई है.

डाल पर फुनगी बन कर आने का ,या फिर फूल बन जाने का , फल बनने का , सभी समय से होता है ,
समय से पक जाना और समय पर डाल से खुद तो अलग कर लेना ही उचित है .
औरों को भी तो फुदकना है , फूलना है ,फलना है न 

तीन कमियाँ देखने में आती हैं – करने की कमी , जानने की कमी और पाने की कमी ।

A few decades ago we as a society resisted Trade marks and copy-rights, still to-day we do not think high of those who assert their Trade-Mark -Rights or Copy -Rights and courts or police in India do not come promptly to control the infringements of these rights- even to-day those who assert their rights as a writer, composer, singer etc. are not taken in healthy esteem- We have never encouraged IP... creators nor do we provide stimulant for IP entrepreneur- to know IP law is one thing, to fight tooth and nail for IP awareness is different. We do not have Indian IP Vision For next 50 years. We fail to understand that IP law is not mere law but IP declaring factory, recognising mechanism and an independent production process that can independently contribute to GDP of the nation

Only IP entrepreneur knows the entire teething pain, the other odds and lastly how SC is going to decide. Of course investment, confidentiality and ultimate risk factors are always there. We have in India few IP savvy brains, fewer technocrats, still fewer professionals and hardly any one in legal field , none in judiciary. But the new generation will fight against status quoist mind set. No more only defensive attitude, no more protectionist mind-set, let there be a healthy competition- in the long run India will gain provided we encourage our young imaginative minds.

We proved that we are basically IP market or IP consumer and not at all interested in IP creation, production or improvement.
If one (1) and Two (2) are distinguishable and are definitely different numbers , how you are confused in between 100000( one lakh) and 100001 (one lakh and one) , only proportion confused you all.
It takes a larger investment of time ,mind, resources, intuition to make even the slightest improvements after a certain degree of development and only these last cutting edge improvements create the winning IPs but then only learned specialists can differentiate between the two, not everybody and never ordinary minds.
Let us hope better conducive climates for IP entrepreneurs - not for now at least.

If we take and we have taken and succeeded in getting the concept of Intellectual property formalised to a great extent. Then we will have to concede that every property has to pass through a production process- utility creation process, securing it process, processing it process. Like all the manufacturing processes IP Production creation must have more or less same or similar entrepreneurial hazards.
Similarly the process may have to be abandoned mid-way. The entrepreneurial activity carries other commercial, moral, sharing, apportionment, quantifying, inter-se interest-conflict,  entry of new entrepreneurs, exit of entrepreneur for various reasons. Successful IP activity is always welcome but as an society we must be ready for unsuccessful IP adventure. Now the once unsuccessful IP adventure may further be continued either this way or that way. Some time a very rewarding IP adventure may has to be stooped for some time for want of financial resources, natural calamities, health risk of one or some components, for political reasons or some IP established may not be understandable to the contemporary society and may come to be  established at a late point of time


We must take into account all these dimensions of IP. IP is peoples worth, wealth and the state and world community has a duty to recognise IP right of every human basic feature of human independence,  human right and human property.

Expecting inventors to conduct patentability and do drafting is akin to self medication.------- having accessed invention disclosure the IP professional must explore all and every area where patent may be possible.You never know what the examiner is going to reject and what appeals to the examiner.Claim as wide as possible,even remote claims get patents. You cannot eliminate patent value of any proposition at the threshold  without thorough examination by the authorities finally. Indian Court system and its functionaries can be divided into two broad category --- Pro sovereign issues  and Against sovereign issues. They seldom foresee any issue without sovereign issues.

Pure people's issues sans sovereign issues is not Indian Court's' worry.

Indian courts have not been sensitised enough on Intellectual Property Issues across the spectrum. No infrastructure for these peculiar issues. If such an  infrastructure is effectively raised ,court functionaries properly trained , the trained minds and the infrastructure will connect itself with people's issues without reference to  sovereign issues and within less then a quarter of century every thing will be changed.
IP is the first and ultimate civilization fuel,propellent, catalyst..

Controller of Patents ,Ministry of HR, Ministry of science and technology,National Legal Services Authority must join hands to create IP awareness up to each Indian Village. We have unique production and distribution system and techniques. Our village level self sufficient individual workshops  generate several patentable IP every now and then but all is lost because the novelty is not documented- services of IP -Expert is not at all is available to them .Controller of Patents should ensure its presence at least up to block  level. Block level IP services providers may be trained. Two -Working Science- Graduate from each Block  maybe trained up to a working level after providing around 400 hours training in IP field.
Some private player may also venture.It appears that India is an hub of scattered ,guised IP and these IPs can be commercially mined and commercially used. A rough imaginative project report and projection show such a venture rewarding for the investor and such a proposal appear to be rosy.

जीवन की प्रारंभिक रिक्तता , पहचान का न होना , आधार का ही अभाव  कितनी बार कंपकपी पैदा कर गया . अंत को  कितनी करीब से दिखा गया .उपहास की पीड़ा  बार बार दर्द देती रही .बड़े सपनों के कारण अपनों का साथ छुटता गया. अकेले चलने का दर्द बड़ा भयंकर होता है .थोडा सा चल ही लिये या कभी दौड़ने का साहस जुटा ही लिया तो इर्ष्य -बाण  के बीच जीवन को बचा पाना और कठिन लगने लगता है . 

 बार्बरीक को उसकी मां ने यही सिखाया था कि हमेशा हारने वाले की तरफ से लड़ना और वह इसी सिद्धांत पर लड़ता भी रहा। 

राजनीति की समझ सभी को नहीं हो सकती , यह टेढ़ी मेढ़ी तो है ही ,छद्म भी है .इसके अपने मूल्य ,मापदण्ड  तथा आयाम होते हैं जो अन्य क्षेत्रों के प्रचलित मूल्यों ,मापदन्डों ,अथवा आयामों से बिलकुल  भिन्न होते हैं , अस्थाई होते हैं,बहुत गूढ़ रूप से छिपाए गये होते हैं .नये खिलाड़ी इस खेल के अनाड़ी ही प्रमाणित होते रहे हैं .

M FATHIMA BEEVI

The country’s first woman Supreme Court judge, Justice Beevi is among the couple of judges elevated to the apex court after their retirement from high courts. Her appointment to the Supreme Court on October 6, 1989 — over five months after her retirement as a judge of the Kerala HC — was, in fact, viewed as then prime minister Rajiv Gandhi’s olive branch to the Muslim community in the aftermath of the Shah Bano case controversy. She retired on April 29, 1992, but was later appointed member of the NHRC.

In 1997, the Central government appointed her governor of Tamil Nadu, where she was at the centre of a political storm over her decision to ignore established constitutional norms and administer the oath of office to AIADMK chief J Jayalalithaa as the chief minister in May 2001 despite the fact that Jayalalithaa couldn’t contest the Assembly elections due to her conviction in a corruption case.

Upset with the decision, DMK chief M Karunanidhi, who had been responsible for Justice Beevi’s appointment as governor, lobbied hard for her removal. However, she herself put in her papers after the NDA government decided to recommend to the President that she be recalled for not acting independently and failing to discharge her constitutional duties in the aftermath of the controversial arrest of Karunanidhi and two Union ministers by the Jayalalithaa government.

M RAMA JOIS

Justice Jois first hit headlines when, as a lawyer, he was a part of the legal challenge mounted by opposition parties to the India government’s action of detaining all those against imposition of Emergency under the draconian Maintenance of Internal Security Act.

After Emergency, when the Janata Party government ruled at the Centre, Jois was elevated to judgeship in the high court of Karnataka. In May 1992, he went to the Punjab and Haryana High Court as chief justice, but would stay in the post for just three months, resigning over the elevation of Justice N Venkatachala, who was junior to him, as a judge of the Supreme Court.

In June 2002, Justice Jois was appointed governor of Jharkhand by the then NDA government. From Jharkhand, he was shifted to Bihar, a post he held till October 2004, resigning after the UPA government replaced the NDA at the Centre. In June 2008, he was elected to the Rajya Sabha on a BJP nomination.

K S HEGDE

Justice Hegde is possibly only the second judge — after Justice Islam — to have been an MP before being appointed a judge. His career is again similar to Justice Islam’s in that he eventually returned to politics and became an MP again. Incidentally, Justice Hegde’s son — former Karnataka Lokayukta Justice Santosh N Hegde — is also a former judge of the Supreme Court.

Justice Hegde was a Congress Rajya Sabha MP from 1952 to 1957. In 1957, he resigned after his appointment as a judge of the Mysore High Court (now Karnataka HC), from where he went on to become the first chief justice of the Delhi and Himachal Pradesh High Court. In 1967, he was elevated as a judge of the Supreme Court of India, a post he held till April 30, 1973, when he resigned to protest against the appointment of a judge junior to him as CJI by the Indira Gandhi government.

He then re-entered politics, contesting and winning from Bangalore South constituency in the 1977 election on a Janata Party ticket. Within a few months, on July 21, 1977, after the resignation of then Speaker Neelam Sanjiva Reddy to contest the presidential poll, Hegde was unanimously elected speaker of the Lok Sabha, the first time a first-time Lok Sabha MP was elected to the post.

RANGANATH MISRA

Justice Misra, who died recently, had a few firsts to his credit. He was the first chairman of the National Human Rights Commission of India when it was set up in 1993. He was also the first former CJI to join a political party — the Congress — to contest a Rajya Sabha election (1998), which he won. The move raised some controversy. After the end of his Rajya Sabha term in 2004, he was appointed chairman of the National Commission for Religious and Linguistic Minorities, where he submitted a report in 2007 recommending a 15 per cent quota for minorities at national level. As a Supreme Court judge, he had headed the much-criticised one-man inquiry commission that probed the anti-Sikh riots following Indira Gandhi’s assassination in 1984.

BAHARUL ISLAM

His is the first case in India’s history of a politician becoming a high court judge. He would retire as chief justice, then — within a space of eight months — become a judge of the Supreme Court, then quit just 45-odd days before his date of retirement, in time to contest the Lok Sabha elections on a Congress ticket, and win.

Justice Baharul Islam, a prominent Muslim face of Assam, was elected to the Rajya Sabha in 1962 and got another term in 1968. He resigned mid-way to become a judge of the then Assam and Nagaland High Court, now known as Gauhati High Court, in 1972. On July 7, 1979, he became its chief justice. While he retired on March 1, 1980, he was brought back from retirement to be appointed a Supreme Court judge on December 4, 1980.

For some, however, the unusual career took its lowest dip when Justice Islam gave up his Supreme Court judgeship 46 days before his retirement to contest as a Congress candidate from Barpeta constituency, going on to win in a one-sided contest.

मैं तो अंजलियों में पानी भरे घूमता रहूँगा ,शायद कहीं कोई बीज मिल जाये ,मेरे चार बार पानी देने के प्रयास् से  शायद नया जीवन संभव हो ही जाये .
कहीं कोई मुरझा रहा पौधा मेरे प्रयास से बच ही जाये .
कहीं कोई प्यासा मुझे मिल ही जाये और मेरे द्वारा लाये पानी को स्वीकार कर अपनी अगली यात्रा के लिये दुबारा हिम्मत बांध तैयार हो ही जाये .
मुझे मेरी हथेलियों पर एक दीप जलाये घुमने दो ,शायद गहरी रात के अन्धेरें में कोई  एक ही सही ,अपने आप को किसी ठोकर से बचा सके .
रुको ,मैं अपने आप को खोल कर तुम्हारे सामने रख डालता हूँ , शायद मेरी यात्रा के विवरण से तुम कुछ निर्णय अपने विवेक से ले सको .
मेडिकल कालेज के एनाटोमी सेक्सन में मेरे ही जैसों का शारीर ही तो पड़ा है , जिसके माध्यम से तुम कुछ सीखते हो .
जीवन यात्रा में कुछ सीखने के लिये चाहो तो मेरा अपनी मन मर्जी से प्रयोग करो ,हो सकता है तुम्हे कुछ सीखने , जानने को मिल ही जाये .  

पचपनों का बचपना सपना
सपनो में पलता बचपना

सपनों ने जो आँख खोली तो
सारा नभ दिखा इस झोली में

आज पंख खोल उड़ेंगे सपंने
खुल जायेंगे अपनों के अपने

खुलते अपने ,खोलते अपने
अपनों के संग झूलते सपने

औपचारिक परिवेश में या नितांत औपचारिक शब्दावली में समुचित शिक्षण या प्रशिक्षण, हो ही नहीं सकता
-गमनागमन का माध्यम कुंद हो जाता है ,शिक्षा का अनौपचारिक स्वरुप , माहौल , माध्यम ही शुरू से अंत तक भला. सीखने सिखाने का रुचिकर माहौल बनाइए, उसे बनाये रखिये और उसी स्वक्षंद माहौल को अगली पीढ़ी तक बिना भय या अविश्वाश के जाने दें . हाँ अपने अनुभवों को बिना लाग लपेट के पूरा का पूरा अगली पीढ़ी को बता जीन का साहस तो आपको रखना होगा , यदि आप अगली पीढ़ी के लिये अपने दायित्व को समझते हैं .

अपनी ही कहना ,सुनना ,कहते रहना ,सुनते रहना - यह लोक नीति नहीं होती , मेरा आपका कहा  सुना , लिखा पढ़ा सब कुछ सापेक्ष होता है - मेरे सम्पूर्ण व्यक्तित्व ,कृतित्व ,यहाँ तक की मेरा विचार भी समाज द्वारा सदैव जांचा परखा जा रहा है - निरंतर .

मेरा अंतर्द्वंद छिपा थोड़े ही रहेगा . लोकमर्यादा ही निर्वहन योग्य है .

Our tax laws are most unstable and seldom enforced against politicians.
Uniform of a politician , is the surest way to ensure safe tax evasion route.
Our other property laws can not be effectively enforced through Indian Court System within any given time frame. Litigation has  free entry pass but no resolution exit without at least a quarter of century. Actual civil reliefs are seldom seen .

Our  criminal justice system has grown manipulative, Law, legal procedures and all its functionaries without any exception can be manipulated politically, legally, monetarily ,socially ,ethically, morally .

Our laws are either too fragile or too obsolete. Either we are unstable or stagnant.

Better to leave than live surrenderingly.

अपनी शक्ति के प्रयोग की अनुमति किसी दुसरे को देने से अच्छा है , चल दीजिये ,दूसरों के लिये जगह दीजिये. अपने कंधे दूसरों को उधार देने से अच्छा है चल दीजिये . कठपुतली  भी अपना ही रोल करती है ,हम तो फिर भी मनुष्य हैं

आम अरुणाचली अभिवादन में ‘जय हिंद’ कहता है। वहां कुछ पड़ोसी प्रदेशों की भांति राष्ट्रविरोधी बगावत है ही नहीं। वहां कारागार नहीं निर्मित हुए। पांच दशक पूर्व जब चीन ने हमला किया था तो इन अरुणाचली किसानों और गृहणियों ने भारतीय फौजियों को अन्न, आश्रय और सूचना मुहैया कराई थी। अरुणाचली सब बौद्ध होते हैं जिनके इष्ट देव दलाई लामा को भारत में सम्मान दिया जाता है। सकंल्पशक्ति का अभाव दशकों से भारत सरकार में दिखता रहा है, जब बारबार चीन अरुणाचल वासियों को चीन आने का वीजा नहीं देता। चीन की जिद है कि अपने ही देश आने के लिए इन अरुणाचल वासियों को कैसा वीजा? भारत एक पुंसत्वहीन पुरुष की भांति अपने ही स्वजन पर अत्याचार देखता रहता है। तब जनता दल वाली गुजराल-गौड़ा की सरकार थी। उनकी विदेश राज्य मंत्री कमला सिन्हा ने राज्यसभा को बताया कि अरुणाचल मुख्यमंत्री गेगोंग अपांग को चीन ने वीजा देने से इनकार कर दिया। वामपंथी, विदेश नीति के माहिर इंद्र कुमार गुजराल दुरूहता को टाल गए। दिसंबर 2007 को लगभग सौ सदस्यीय आइएएस अधिकारियों को चीन यात्रा रद्द करनी पड़ी क्योंकि अरुणाचल के गणेश कोयू को चीन ने वीजा नहीं दिया। तब सुझाव आया कि भारत भी ताइवान गणराज्य के नागरिकों को अलग से मान्यता दे और वहां अपना राजदूतावास बनाए। मगर ऐसा निर्णय करना कलेजेवाली बात हो जाती। शौर्य भरा कदम होता।

यहां इस तथ्य को भी याद कर लें कि सत्रह वर्षों तक कोई भी भारतीय प्रधानमंत्री अरुणाचल नहीं गया। वर्ष 2008 में मनमोहन सिंह गए थे क्योंकि भारत की जनता का दबाव था कि क्या अरुणाचल प्रधानमंत्री के लिए वर्जित क्षेत्र है? हालत आज ऐसी है कि लुम्ला से कांग्रेसी विधायक टीजी रिंपोची ने अप्रैल 2008 में चीन की विस्तारवादी नीति के विरोध में जन-प्रदर्शन करना चाहा तो मनमोहन सिंह सरकार ने उस पर पाबंदी लगा दी थी।

भौगोलिक, राजनीतिक और ऐतिहासिक तथ्यों के अलावा भी अरुणाचल को भारतीय मानने का एक बड़ा तर्क है जिसे विश्व मानता है। अंतरराष्ट्रीय कानून भी स्वीकार करता है। महर्षि रिचीक के पौत्र, जमदग्नि के पुत्र परशुराम का आश्रम लोहित जनपद में आज के इटानगर राजधानी के समीप अरुणाचल में है। बौद्ध स्तूप यहीं सदियों पूर्व बने थे। कल्कि पुराण के अनुसार ऋषि शांतनु और उनकी पत्नी अमोघा यहां आश्रम बनाकर रहते थे। मत्स्यपुराण में अरुणाचल के मालिनीथान भूभाग की मिट्टी का विशद उल्लेख हुआ है। पुराण के अनुसार यहीं पार्वती ने कृष्ण को सत्यभामा से उनके विवाह पर फूल भेंट किए थे। कृष्ण ने पार्वती को मालिनी समझकर इस भूभाग को मालिनी क्षेत्र कहा था.

फिर भी अगर मनमोहन सिंह सरकार चीन के जियाबाओ से अरुणाचल को भारतीय कहने में हिचकें तो लोकसभा की बहस के अंश का जिक्र कर दें। तब (1956) रक्षा मंत्री वीके कृष्ण मेनन ने कहा था कि जिन सीमावर्ती क्षेत्रों पर चीन ने कब्जा किया है वह बंजर है। वहां घास भी नहीं उगती। जवाब में प्रश्न किया था देहरादून के कांगे्रसी सांसद महावीर त्यागी ने कि ‘मेरी गंजी खोपड़ी पर भी कुछ नहीं उगता है; तो उसे भी चीन को दे देंगे?’ उस वक्त नेहरू केवल मुस्कराए थे। आज लॉर्ड कर्जन की 1903 में कही बात याद कर लें: ‘हिमालय आज भारत की रक्षा करता है। वक्त आएगा कि भारत को हिमालय को बचाना होगा।’ सरदार पटेल, फिर लोहिया ने बहुत पहले इसे दुहराया था। भारत सरकार मूक रही। मगर फिर एक दफा मतदाता मुखर रहे। अपनी पसंद का बटन दबाया। भारतीय लोकसभा का सम्मान किया.

 मालोगांव के मतदाता बूथ पर 100 प्रतिशत मतदान हुआ है। वजह इस बूथ पर केवल दो ही मतदाता अपने मताधिकार का प्रयोग करते हैं। मालोगांव अरुणाचल प्रदेश के अंजाव जिले का हिस्सा है। केवल दो मतदाता जोहेलम तएंग और उनकी पत्नी सोकेला तएंग हैं। यहां से सबसे नजदीक गांव दस किलोमीटर दूर स्थित तिदिंग है। मालोगांव राज्य का सबसे छोटा मतदान बूथ है। दस मतदानकर्मियों की एक टीम भेजी गई ताकि लोकतंत्र बरकरार रहे। बूथ तक पहुंचने के लिए टीम के साथ दस कुली भी होते हैं क्योंकि उन्हें कई किलोमीटर के दुर्गम रास्ते को पार करना होता है, जिसमें बीच में कई छोटी धाराओं, ऊबड़-खाबड़ रास्तों और घने जंगल से गुजरना होता है। इस पुरातन क्षेत्र में लोकतंत्र की जड़ें इतनी पुरानी हैं कि हर वोटर को पूर्ण सुविधा दी गई है।

Choose before you decide. You cannot chose after you have decided. Take all of your decision, good or bad. Face all the risk that comes your way .No more options after you have made your decision.
Life and its every moment has a price tag. The price you pay has nothing to do with the quality of life you are served with . Life has competing versions and you cannot choose a life of your own choice. All the risk is always yours.

Intellectual Property Concept - A road map for 21st century IP Movement 

 

  If we take and we have taken and succeeded in getting the concept of Intellectual property formalised to a great extent.then we will have to concede that every property has to pass through a production process- utility creation process, securing it process, processing it process. Like all the manufacturing processes Ip Production creation must have more or less same or similar entrepreneurial hazards.  

Similarly the process may have to be abandoned mid-way. The entrepreneurial activity carries  other commercial,moral, sharing, apportionment, quantifying, inter-se interest-conflict,entry of new entrepreneurs, exit of entrepreneure for various reasons. Successful IP activity is always welcome but as an society we must be ready for unsuccessful IP adventure. Now the once unsuccessful Ip adventure may furter be continued either this way or that way. Some time a veryewarding IP adventure may hae to be stooped for some time for want of financial resources, natural calamities, health risk of one or some components, for political reasons or some IP established may not be understandable to the contemporary socirty and may come to be established at a late point of time

So I call upon the IP activists to explore IP  world under the following brackets. The exercise that I am proposing has to be pursued continuously till it reaches a logical result, It may take several brain-storming sessions, sitting togeter of fertile imaginative minds and persons in authority, but please look into these aspects.

समर्थ और शक्तिशाली बनो , एक कदम पीछे हटो ,सर ऊँचा करो ,चारों ओर घुमाओ ,चारो ओर जितनी दूर देख सकते हो देखो ,रुको ,समझो ,समझ कर अपने शिकार अथवा लक्ष्य की ओर झपटो , हो सकता है थोडा दौड़ना पड़े , थके बिना शिकार के थकने तक पीछा करो ,-----जीवन और आध्यात्म यही सिखाता है 

खुदा का शुक्र है  या ईश्वर की कृपा , यह तो नहीं कह सकता पर आज अच्छा लग रहा है की मैं झुका तो नहीं ही हूँ , तोड़ने का दम्भ भरने वाले अब यह आभाष लेते होंगे ,भले , पर मैं न झुका , न मैंने अपने हाथ गंदे किये , न ही मन ,बुद्धि गन्दी होने दी , मैंने गन्दगी का  साथ नहीं  दिया , बच्चियों की इज्जत से उन्हें खेलने नहीं दिया , बच्चों के सपनों को कोई हानि नहीं पहुंचा सका , नये बच्चों के माता-पिता के आशीर्वाद ने उन ३२० बच्चों के मान -सम्मान ,शील की रक्षा की - मैं परम संतुष्ट हूँ - मेरे बच्चों सदा सानन्द रहना , अखंड यश के साथ रहना .

डाल पर फुनगी बन कर आने का ,या फिर फूल बन जाने का , फल बनने का , सभी समय से होता है ,
समय से पक जाना और समय पर डाल से खुद तो अलग कर लेना ही उचित है .
औरों को भी तो फुदकना है , फूलना है ,फलना है न

Patent biggies have their own agenda- they hardly look into the basic innovations at the grass roots- they undermine the IP worth of IP piggies---- the present senario confuses and shows how a mutual interest friendly war is going on in between IP  biggies and Law Biggies ignoring law piggies and grass-root IP Piggies

Trust the next generation and let them face tomorrow themselves,.
Stop spoon-feeding  after a stage, stop decidedly.
Don't  resume even if your heart cries.
Let them learn to fight and survive to grow.
That is the real lesson and help  for them,
Let them grow independently .
Let them know that your love, care and help is no more available to them as a matter of right or courtesy or may be never.

  IP Concept- a Journey and pause, Jerk, Jolt
The state and world community has a duty to recognise IP right of every human - the basic feature of human independence,human right and human property.

A few decades ago we as a society resisted Trade marks and copy-rights, still to-day we do not think high of those who assert their Trade-Mark -Rights or Copy -Rights and courts or police in India do not come promptly to control the infringements of these rights- even to-day those who assert their rights as a writer, composer, singer etc are not taken in healthy esteem- We have never encouraged IP... creators nor do we provide stimulant for IP entrepreneur- to know IP law is one thing, to fight tooth and nail for IP awareness is different. We do not have Indian IP Vision For next 50 years. We fail to understand that IP law is not mere law but IP declaring factory, recognising mechanism and an independent production process that can independently contribute to GDP of the nation

Only IP entrepreneur knows the entire teething pain, the other odds and lastly ow SC is going to decide. Of course investment, confidentiality and ultimate risk factors are always there. We have in India few IP savvy brains, fewer technocrats, still fewer professionals and hardly any one in legal field , none in judiciary. But the new generation will fight against status quoist mind set. No more only defensive attitude, no more protectionist mind set,let there be a healthy competition- in the long run India will gain provided we encourage our young imaginative minds.

We proved that we are basically IP market or IP consumer and not at all interested in IP creation, production or improvement.
If one (1) and Two (2) are distinguishable and are definitely different numbers , how you are confused in between 100000( one lakh) and 100001 (one lakh and one) , only proportion confused you all.
It takes a larger investment of time ,mind, resources, intuition to make ev...en the slightest improvements after a certain degree of development and only these last cutting edge improvements create the winning IPs but then only learned specialists can differentiate between the two, not everybody and never ordinary minds.
Let us hope better conducive climates for IP entrepreneurs - not for now at least.

The writing on the wall is clear---reform--if we don't do it ourselves someone else will do it.

Intellectual Property Management Authority Of India- a step to be taken

Why a society like us "'We The People " of India cannot manage the intellectual Property  of our own people or whether our 120+ crores minds do not work at all or worked rarely in the last two centuries or so. Why we are having such a poor inventory of Intellectual property at our command. Intellectual property or call inventions are not always product of very huge investment of resources or time. At times it has come accidently, through intuitions, through mistakes or through only a bit applied presence of mind, small imaginative thinking,petty experimental entrepreneurship.

Intellectual property though present but not identified or not taken into inventory is lost property.
We do not recognise our IP or we fail to locate it .We have failed to secure our IP. We either intentionally or inadvertently do that. Otherwise either we have not been trained on those counts or we have not been sensitised enough.

Any nation who fails to safeguard its wealth, cannot survive . Every sovereign state has a duty to protect its geographical boundaries, National wealth- both corporeal as well incorporeal. The foremost wealth and resource of a state is its subjects- human resource. A state is duty bound to invest vigorously in the development and upliftment of its human resources. Intellectual property is the product of mental exercise, thinking process, imagination, intuition, experiments by men.

Every state has to keep a watch over the national wealth and must ensure its safety. A systematic upkeeping of  national worth is must I sincerely call upon the national think tank of India to moot, propose, explore the establishment of "Intellectual Property Management Authority Of India." with the following objectives-
a) TO create a ground -base data bank of all Intellectual Property like objects, propositions, innovations, ideas whether still finally established or still unrecognized or not. This should be spread up to Gram Panchayat Level and can be manned at village level by IP Identifier Volunteer Force.

b) To establish Technical Laboratories  in order to cater to the needs of small IP Entrepreneur and to assist the other IP activists

c)To establish Legal Laboratories  as well service centers to help small IP Entrepreneur and to assist the other IP activists

d) To establish a Legal Action front equipped with world class IP law knowledge with very sound Technocrat professional Force to assist Indian  small IP Entrepreneur and to assist the other IP activists in courts

e) To establish an IP management fund structure to be utilised exclusively for creating, managing, docketing, locating IP worth of India.establishing IP base clinics at village level, IP referral Centers at District Level and state level IP management Center and Central IP management  center, data Bank and utility Center- Authority. To build infrastructure for IP Procedure Code  and developing the norms for the same .

f) To establish an IP Litigation and Protection Fund to be utilised to create awareness about IP, IP-laws,IP Concept, IP protection and confidentiality,Ip transaction, , IP legal procedure, IP Education, Inclusion of IP importance in school curriculum, for supplementing and raising effective court-resource persons as well for raising IP Volunteers Force, equipping Indian Law campuses
and Technical Institutions with IP knowledge infrastructure. And to create an independent IP PROTECTION BODY and to carry IP procedure code.
 g)To raise an Indian Data Bank exclusively for IP purpose.

A judge punishes not because he can but because he must. A judge refuses relief not because his conscience commands him to do so but because law does not permit a particular relief in a particular circumstance . If law permits relief in a particular circumstance , it is none of the business of a judge to deny the relief only because the conscience of the particular judge fails to respond to the law and law that is judge administered justice is justice alone.
