manage stress
Judges must be trained to manage stress on the izlash , the stress during examination of records, the one while dealing with the litigant with very high expectation and ill fed vision about his own stand, the intense heat of getting one's own view vindicated at all and every cost, the stress due to highly professional group of lawyers trained to create pressure on the court and judge and test him, the stress when preparing hor the judgement and the stress when the judge is pregnant with the judgement still he has to move around the same society among the same or similar men.
Knowledge makes a man rational and thoughtful
Doubt is usually the sign
of an enlightened mind. In our parts, however, it is seen as indecision
when we are assessing leadership and therefore something not heroic.
Certitude is seen by
Indians as a virtue in making leaders strong and decisive. But it is
equally an indicator that its possessor suffers from a lack of awareness
of opposing arguments, of lack of data and information. This is a
universal problem, of course. In the West, it is the conservative who
yearns for decisive leadership and a stamping of authority. Later, when
the decisive leader produces a war that is pure stupidity, the
conservative is baffled and chastised.

प्रश्न खड़े करना सीखो। प्रश्नों को सलीके से पूछना सीखो।
प्रश्न दागना एक कला है। सामने वाले के सामने प्रश्न को शान्ति से रख भर देना, फिर प्रतिक्रिया का इन्तजार, बस यही तो सीखना है।
प्रश्न पहचानना भी कला है। प्रश्नों का संभालना भी कला है। जाने कब किस प्रश्न का जबाब कहाँ मिल जाये।
सभी प्रश्नों का जबाब तत्काल न तो दिया जा सकता हैं न तत्काल जबाब देना जरूरी है। किसी किसी प्रश्न का जबाब देने में तो पीढ़ियाँ लग जाती है।
खुछ प्रश्न सार्वकालिक होते हैं।

प्रश्न देखने से, सुनने से, पढ़ने से, ज्ञान से अनायास बढ़ते है, पैदा हुए ही जाते हैं, थमने का नाम नहीं।

दिन-रात, समय-कुसमय कुछ भी नहीं देखते।, जब मन किया चले आये। आने का भी तरीका नहीं। कभी एकदम से ठीक आँख के सामने, पलक झपकते।,कभी सोचतै सोचते। कभी सपनों में तो कभी नाचते -घोरते-। कभी- कभी तो इतने चुपचाप की पता ही नहीं चलता कि प्रश्न बगल में ही खड़ा है और व भी कब से।

justice and equity.
Equity is user specific.
Equity has always to be seen in reference to a particular frame.
Though the principles of equity are universal but blending of those several principles and law are always to be in user specific or situation specific ratio and proportion and this optimum ratio and proportion in mutually competing circumstances and belligerent individuals is justice.
A verdict which confirms to this optimum rationale taking into view present, past , future, individual , society, law and due process, due diligence and legitimate expectation, is just decision and justice.
That which upholds justice upholds society, that is equity.

Urging parents to inculcate reading habit in children, Kalam said, "Every one of you should set up a home library. It's not necessary to have 100 books. Start with 10 books, and let your children convert it to 100 and grandchildren take it to 1,000 good books."
Book lovers, from the young to the old, left no stone unturned to catch a glimpse of Kalam, also known as country's Missile Man. Calling books a life long treasure and precious property, Kalam said, "Good books can transform human life and make life happier.''

This righteousness, he said, can only be created by a father, a mother in a spiritual environment and a primary school teacher. This judiciary has saved our national honour on all national and international platforms.
Our judiciary proved right, courageous still restrained within the four corners of its ambit of being judiciary.

The judges of 21st century must know that to-day fairness with speed, accuracy with promptness, clarity with completeness, punctuality with perfection, .timeliness with transparency are the key words.
Today's judiciary cannot afford the luxury of embroidery of cool time invested to deliver justice. Delay denies justice. delayed justice is not justice.
Please for get- better late then never.
Never late and ready ever.
Uniform justice, standard justice and not judge's justice has to be ensured.
Let not justice be defined every-time, a judge is changed. Let not individual
vision eclipse or blur the legal vision of just justice.
The wisest is still to be born.
Trained judges must learn to overcome personal prejudices and must have a constitutional-army-view of justice shared equally with equal force along all the layers of judges. Judges have no class,nor caste, creed nor individuality.
Judges are never divine. Nor law is divine. King is not divine.

Every
body in public domain must maintain a No Entry Zone- Aloofness Circle
where one must be only with ones public responsibility and personal
relations must not have entry in that space- Shashtri Jee , Rajen Babu,
even JRD, did so-- Judges must do that at all cost. This No Entry Zone of the Judge makes him a perfect Judge.

maintain judicial aloofness during their tenure and there mindset is
tuned differently,analysing differently but their impartiality efforts
cost them dearly, their minute observation and talking no nonsense
oration makes their post retirement life a bit difficult, they get
unfriendly gestures from their own people whom they could not oblige as
per their wishes and now those all socially maintain distance- I beg
your pardon

Judges cannot afford to be popular.
They are not supposed to be king's voice or command but are supposed to be voice of conscience, goodwill and fair-play.
Judges must not crave for publicity and must resist all sort of temptation, even at the cost of criticism.

One of the effects of high litigation cost

high cost of litigation is perpetuating and encouraging state to collect
taxes illegally or impose penalty in a way not permissible in law but
with a hope that taking into the cost of litigating further will itself
dissuade the victim of such arbitrariness from getting his stand
vindicated.

Indian Courts in motor Vehicles accident cases taking these cases as
routine cases without examining the economics of such causalities is
giving ample opportunity to insurance companies to earn
disproportionately.

It is not very important how we treat present. Past is gone and not much is going to change because that which is gone is gone for ever.
Foremost thing is how we scan past, learn from it and get ready for the future.
Both ends of present- past as well future; are endless.
We must train our wisdom in the light of past with an eye on future- not to repeat the mistakes of past and to recreate what appears to be lost and discover and invent the new pathways .

We must be ready to share it.
Do we have a desire to learn and take appropriate curative, remedial measures based on that revelation in our balance sheet ?
It is usually more difficult to do so than to propose .
Wait till I re-configure my self and try to match what I say and what I do.

This will raise the esteem of Judiciary in the eyes of general public , especially the grass root people.
The grass root Judiciary will have another face to be presented before general public and in this way the image of grass root Judiciary can be strengthened-
But then additional hands and resources must be provided and a Disaster Management Wing in the Judiciary capable and willing to help the general public has to be raised under the authority of suitable law.
During such period Local Bar and its members may be authorised under suitable legal provisions for making civil investigations, recommending declaratory decrees /certificates / compensation awards to be confirmed by regular court after verifying and checking the documents and hearing summarily such parties as the court deems fit and proper and which can be summarily annulled if fraud is detected and for such role of the bar certain sum can be allocated at the disposable of Bar to be used for the purpose.
More can be conceived as a role for legal and judicial fraternity in such urgencies.

Law school curriculum should have special focus on mass legal services in extra ordinary situation

Crime against our own time
Time is brutally murdered , that too without planing and without any motive of intention , not even for any gain to one self or loss to others . A mammoth crime without application of mind that never goes without proportionate punishment by nature. The only thing we are losing every moment without any possibility of reclaiming it again is wilfully murdered our own time
Why do we need an induction training- a threshold training for new incumbent judges at the entry level it-self, is a question asked so many times and there are answers to this question but those answers have not answered the question fully and finally.
May be for these reasons-

Effective training means sustainable training. It means transforming a persons in such a way that after training he can be easily, apparently identified that he is now trained and is different from an untrained and further that he shall never be the earlier individual again.
Training within an institution, that we call institutional training means making the incumbent aware of all conceivable dimensions of his future within the institution and making the individual more useful for the institution.
It further means the process of reading each individual minutely so that each person inducted within the institution can be used more effectively for the institution and each persons individual peculiarity and added potency can be utilised more fruitfully for the institution.
Training is streamlining, checking the alignment and set them and developing a uniform mindset that must confirm to a standard vision.
Judicial training means setting the mind within Indian constitutional boundaries and raising an army to protect the constitutional vision, solemn oath in order to secure, process and deliver justice to all of us. Taking seriously all that is -from individual discipline to institutional norms, from law to law and order, and art of dispensing justice transparently through speaking judgement based on law, constitution and precedents without being influenced by inner prejudices. To invest oneself and all the time one as to the cause of uniform standard judging. To co-ordinate with all the segments and stake holders in order to make out maximum satisfaction of all those involved. To ensure timely delivery of justice. to understand that now speed is the key word in every area of our activities

विचार कर कर देखिये- पुराने राजघरानों का भारतीय विदेश सेवा, प्रशासनिक सेवा, सेना के उच्च अधिकारी पद, विशिष्ट राजनैतिक पद आदि पर बाहुल्य है।

जो खास थे वे खासम-खास, गुलाब खास और सुगंधित खस-खस हो गये, खास लोगों के बीच खास जगहों पर सजे हैं या खास सुगन्ध से खासों के यहाँ लटके है- खास थे , खास हैं , शायद आगे भी रहेंगें ही ।
आम तो आम आम है, कोई गुलाब खास थोड़े ही है।
आम आम को खा दिया गया, यही बहुत है। आम आदमी चूसा हुआ आम है।आम की नीरी गुठली है।
आम आदमी को और क्या चाहिये। पूजा में आम का पत्ता लगता ही है। आम आदमी को संतोष ही नहीं है ।
वी द पिपुल आफ इन्डिया लिख देने से क्या कुल वंश खानदान बदल जायेगा।
और यदि बदल ही जायेगा तो भी दो तीन सौ साल लगा दिये जायंगें ।
वी द पिपुल आफ इन्डिया की व्याख्या में भी तो खास लोग ही बैठे हैं- राजघरानों में ,औद्यौगिक घरानों मे तथा और खासों में दोस्ती इतनी कमजोर नहीं पड़ गई है कि आम आदमी शिखर तक खाम खाह बात करने लगे।
हाँ, कभी काल ऐसा होने लगा है- पर बहुत रेयर ही है

If
you are not ready to be greedy, you are going to be kicked out of main
stream society where greed is exchanged on mutually agreed terms, not on
proportionate consideration but on whims, emotions, urgency,
resist-ability, elasticity, intelligence, cunning-presentation, and even
under duress, coercion misrepresentation and undue-influence.
Fraud,fabrication, suppression are acceptable social norms. People have been telling me for the last forty years that there is nothing like corruption- an issue before the society.
I have been denying and perhaps shall keep denying this proposition.
I shall fight my own greed tooth and nail, even if i am alone.
Better to be poor then being corrupt and greedy.
My greed shall be watered by only those whose greed will be served by me.
I will have to be a part of GREED_LOBBY.
I want to resist, be contended.
At the end of my life , I will not make a will how my greed has to be disposed of. I will not whisper about my hidden greed, nor look around for the person with whom I can share my last moment of anxiety. Let peace come to me peacefully.

हाँ या नहीं
वस्तुतः हिन्दुस्तान में एक पूरी की पूरी पीढ़ी बिना जिम्मेवारी के जीने
की अभ्यस्त हो चुकी है । उनका बस चले तो वे साँस भी दूसरे के भरोसे लें ।
हिन्दुस्तान ही क्यों, पूरे विश्व में काम करने वालों के नाम पर काफी हल्ला गुल्ला होता है।श्रमिकों के नाम पर पूरा का पूरा वर्ष मनाया जाता है । पूरी की पूरी एक विचार- धारा है,पर किसी को किये के फल, सुफल या कुफल या असफल की चिन्ता नहीं। ऐसी पूरी पीढ़ी समाज के लिये खतरा बन जाती है।
आप धनी लोगों से घृणा करते हैं, पर स्वयं धनी बना चाहते हैं।आप धन से घृणा नहीं करते। आप संपत्ति में बँटवारा चाहते हैं,आप लाभमें हिस्सा चाहते हैं, सनृद्धि में हक जताते हैं।
कभी सोचा, लाभ आया कैसे,धन बना कैसे,सनृद्धि आयेगी कैसे। धन रहेगा तब ना बँटवारे की बात उठेगी। धन या धनी रहेगा ही नहीं तो--------।
आपने शहद देखा है। मधुमक्खियों के छत्ते भी देखे ही होंगें।
कैसे लगेगा जब दिन रात मिहनत कर रही इन असंख्य मधुमक्खियों को कहा जाये कि इन्होंने बगीचे के फूलों का शोषण किया है। फूलों से पूछिये तो सही इन मधुमक्खियों, तितलियों, भौंरौं ने इन्हें क्या दिया है। इन्हीं मधुमक्खियों, तितलियों, भौंरौं ने फूलों में बीज पैदा होने की प्रक्रिया में अपना योगदान दिया है। फूलों को मुस्कुरना सिखया है। किसी वनस्पतिशास्त्री से पूछिये,ये शहद की रचना करने वाली मधुमक्खियों का इन फूलों के जीवन में कितना योगदान है।
फिर एक बार सावधान होकर सोचिये।आपने शहद देखा है। मधुमक्खियों के छत्ते भी देखे हैं। मधुमक्खियों का आते जाते भी देखा है। पर शहद लेकर आते जाते उड़ते कभी किसी मधुमक्खी को देखा है। मधुमक्खियाँ फलों के जीवन का अभिन्न अंग है।
प्रकृति में सभी कुछ परस्पर जुड़ा, संबंधित , आश्रित होता है।
मधुमक्खियाँ की सतत मिहनत तथा फलों का सतत जीवन क्रम ही शहद की पूर्व शर्त है, परस्पर सहज स्वरूप है। शहद के निर्माण का यहि प्राकृतिक नियम है- परस्पर आश्रय।
शोषण के लिये कोइ स्थान नहीं।
कभी सोचा है बिना मधुमक्खियों के जीवन कैसा.
हिन्दुस्तान ही क्यों, पूरे विश्व में काम करने वालों के नाम पर काफी हल्ला गुल्ला होता है।श्रमिकों के नाम पर पूरा का पूरा वर्ष मनाया जाता है । पूरी की पूरी एक विचार- धारा है,पर किसी को किये के फल, सुफल या कुफल या असफल की चिन्ता नहीं। ऐसी पूरी पीढ़ी समाज के लिये खतरा बन जाती है।
आप धनी लोगों से घृणा करते हैं, पर स्वयं धनी बना चाहते हैं।आप धन से घृणा नहीं करते। आप संपत्ति में बँटवारा चाहते हैं,आप लाभमें हिस्सा चाहते हैं, सनृद्धि में हक जताते हैं।
कभी सोचा, लाभ आया कैसे,धन बना कैसे,सनृद्धि आयेगी कैसे। धन रहेगा तब ना बँटवारे की बात उठेगी। धन या धनी रहेगा ही नहीं तो--------।
आपने शहद देखा है। मधुमक्खियों के छत्ते भी देखे ही होंगें।
कैसे लगेगा जब दिन रात मिहनत कर रही इन असंख्य मधुमक्खियों को कहा जाये कि इन्होंने बगीचे के फूलों का शोषण किया है। फूलों से पूछिये तो सही इन मधुमक्खियों, तितलियों, भौंरौं ने इन्हें क्या दिया है। इन्हीं मधुमक्खियों, तितलियों, भौंरौं ने फूलों में बीज पैदा होने की प्रक्रिया में अपना योगदान दिया है। फूलों को मुस्कुरना सिखया है। किसी वनस्पतिशास्त्री से पूछिये,ये शहद की रचना करने वाली मधुमक्खियों का इन फूलों के जीवन में कितना योगदान है।
फिर एक बार सावधान होकर सोचिये।आपने शहद देखा है। मधुमक्खियों के छत्ते भी देखे हैं। मधुमक्खियों का आते जाते भी देखा है। पर शहद लेकर आते जाते उड़ते कभी किसी मधुमक्खी को देखा है। मधुमक्खियाँ फलों के जीवन का अभिन्न अंग है।
प्रकृति में सभी कुछ परस्पर जुड़ा, संबंधित , आश्रित होता है।
मधुमक्खियाँ की सतत मिहनत तथा फलों का सतत जीवन क्रम ही शहद की पूर्व शर्त है, परस्पर सहज स्वरूप है। शहद के निर्माण का यहि प्राकृतिक नियम है- परस्पर आश्रय।
शोषण के लिये कोइ स्थान नहीं।
कभी सोचा है बिना मधुमक्खियों के जीवन कैसा.

कानून बनाये जाने के पहले उसकी अवधारणा को समाज के बीच फैलाना, समाज को उचित प्रकार से प्रशिक्षित करना परम आवश्यक है। समाज की सहमति प्राप्त कर बनाया गया कानून समाज को सहज स्वीकार्य होता है , ऐसे कानून का सामान्य अनुपालन सुनिश्चित करवाया जा सकता है । ऐसे कानूनों से भय ,शोषण तथा भ्रष्टाचार पैदा नहीं होता है।
बिना उचित सामाजिक प्रशिक्षण के बनाये गये कानून को लागू करना राज्य तथा समाज दोनों के लिये कष्टकारी होता है।

Own this system as your own - not complainingly
I train you for the future but I cannot predict the future. None can control the future. Every coming moment may be new and I know it will be altogether new.
Right now as a trainer I can only give you some Loin's gaze, hawk-eye view of how the time passed and what the past taught us.
I can imagine something which I will pass to you but none can be sure whether the past will repeat or not and even if past repeats, whether it will not be different each time.
My experience shows similarities and dissimilarities shall always be there and so every time you will have to take your own wise decision based on your further vision and my experiences shared with you.
I will show you what I was, What I wanted to be and ultimately where I landed myself and why?
I will learn from you , what you are, what you want to be and what you fear and why.
I believe you have your own preparation about how you will lead your future, how you will carry the system ahead and how you will shape yourself and the system. You all know that now onwards you will have more of duty, responsibilities then rights.You all have volunteered to be a public face of the system. Now you cannot shirk or complain about the risks, difficulties, insufficiencies in the system. You can try to contribute to improve the system working-quality wise as well quantity wise but if you are in the system you cannot take only the glitter and leave the rest. You will have to take the whole of the system- all at a time. No more complains so long you are in the system. Improve it, if you can,that is good.Leave it if you feel dissatisfied and unable to bear but never, I say never only complain. Like all other system this system is not perfect and can be improved. There are many things around which we could not do in spite of the fact we always wanted to de. There may be thousands of those reasons but now onwards when you have chosen to be part of this system you will have to improve ,address owning this system as your own - not complainingly.

Before exposing the incumbent to training of any kind the system must be very clear about the objectives, standard, expectations, methodology, input-output relationship, the capability of the person to be trained, the training target, time schedule, results anticipated, the training module and material, the trainer and the mode of evaluation.
The system must ensure that the training is really taken seriously. Training that is not received and evaluated or measured in terms of quantity and quality is no training.
A toothless trainer seldom performs. An unwilling trainee never performs.
The performance of the trainee at the training stage reflects the receptivity of trainee.
A trainee resisting modulation and consistently rejecting to receive the basic value of the system must be sorted, singled out at the time of training itself. These individuals may be risky to be allowed entry into the system.

Training the future generation is to prepare them for a forward journey. Trainer must be ready with forward vision.

A really good news is that we have entered into an era of judicial training, standardisation, efficiency -enhancement etc and have raised infrastructures, made investment, grown conscious for judicial academies and training.
But a new problem-
Where is the Judicial target, aim, benchmark.
What is the time schedule for achieving something measurable from these exercises?
How will we evaluate the impact, effectiveness of this training programmes?
Do we have a even working training modules?
Where are the trainers?
Whether the trainers themselves are trained or at least exposed to training tools, art and strategy?
Where are the training literature? Where is judicial literature?Where is judiciary -examination body? Who will examine the trained judges?Who will examine and update judicial academies and administer them across the country to inject uniform judging norms.
But a new problem-
Where is the Judicial target, aim, benchmark.

What does it mean to be in the judicial academy for training as a judge?
Earlier, say only before 2004 there was no judicial academy and no training of all the judges inthis organised way.
Now that it is, What does this mean to the society, to the judiciary ant to you as a group and as an individual judge.
Being trained by a judge one to one at a station- what does that mean?.
What difference the present training module would make?What we will get out of this exercise?
Whether this investment by the society as any aim, if yes what is that?
How you from your side try to fulfil the aim?
How this academy can help you all?
You all are on race track and has to run for the society up to justice and you have law as your trainer and your fairness, conviction to the constitutional cause as your guide.
You will have to face several challenges, not only in the court but from your family, your own society , your individual concern and then you can justify your being a judge- as sober as a judge.
Get set, get groomed as a judge, above threats and temptations; only stand for righteousness, for that what is just, let the society stand right, firm and forward.

What do we mean by making a judge?
In order to make a judge you will have to weed out certain elements, from the prospective judge, weed them out completely.
Then you will have to trim certain elements , prune them as per requirement and teach them to keep on pruning at such intervals as and when required.
Then you will have to locate those elements whic though present are not in optimum form or quantity of not of standard quality.
You will have to treat them , manure them, take extra care of them and teach the prospective judge that these are the characteristics that have to be maintained at least at this or that level.
Ultimately you will have to raise endurance level, boiling level, survival level of the person to withstand the extreme requirements of the job.
Then you will have to tell them, teach them what they have todeliver. let they be made familiar in allitsdimensions about end product they have to deliver.
Divine thory of law and judge is no longer in practice. It cannot be advocated in any form.
And ultimately conceive possible risk factors, apprise them of those, show them those, let them feel the extreme actions,reactions and expose them not through words but through live demo.
Let them know the tools available to manage the risk.

I am not the first nor the last to repeat all these. If I can contribute any thing new in this vast world of knowledge in my whole life by trying to understand this whole system, even if it is as insignificant as a droplet in the sea, a spark, or a twinkle, I shall leave this world with utter satisfaction that I have served my purpose- I want to leave contributingly, my palms wide open, my whole being for all from whom I had so much of what not
Reading intelligently is an art, difficult to master.
But still more difficult is to find out what to read and what not to read.

पर इस श्रेणी का लेखन विरले ही कर पाते हैं। ऐसा करने वाले को अपना दोष स्वीकार मुद्रा में लेखन करना पड़ता है। यह कठिन है।
अपने प्रयोगों को सांगोंपांग बता देना सर्वोत्तम लेखन है।
कुछ भी छिपाये बिना लिख डालना कठिन है।
अपनी यात्रा का पूर्ण विवरण प्रकाशित कर देना -सहज तो नहीं पर समाज के लिये उपयोगी जरूर है।

Leave me alone with my books and deeds.
I am responsible for what I do and read.I take the responsibility of my deeds. I take the responsibility of the way I spent my time. I admit all that I did, thought, experienced.
I wish I could afford a pause to sharpen my wisdom and refresh my learning. I wish I could draw a complete balance sheet fairly,and honestly. I will do that even if it is risky. I must come clean for public scrutiny.
I want some time to repay those scholars who wrote, thought, did not sleep, experimented, sailed across, crossed the mountains, laid down their lives in their pursuit for knowledge and truth. I have to think with open eyes and write down my own experiences informing you all what ever I learnt, suffered, saw, found, lost, took away. I have a duty to return all back tothose scholars and for the next generation.
One thing to be sure- each coming day and generation is bound to be happier, shinier, wiser and will lead to further healthy growth.
I know I will not be for ever.
But before I leave, I must repay you all whatever I owe and handover what ever I have and can but I must take away my sins that I do have with me begging to you all for my sins and bidding you all a very good -forward looking never ending chain of never ending mornings with fresh untouched morning dews and sweetest twitters.

Even if a rapist and a murderer deserves death, a penalty under the law accepted to be inflicted by the society, there is nothing the society can enjoy this death penalty. Society must feel ashamed for this and every other death of a human being. The society cannot be proud of this death penalty nor the society rejoice. If this is Justice, the society must not raise head with pride, must rethink and at least be sad and ashamed of the way justice is done.
Let law prevail but with added caution.
Law alone is not justice.
We are in the society only for justice and dignity.
Let us try to ensure these. We may have failed up till now. Let us not fail further.
Rethink, rework, redo and one day we will have a better way to secure justice for all.

Evolve a system that speaks, works, responds and not those persons that have to speak or perform.
Person specific perception should be avoided. A self propelling system that carries the driver also and the passengers also must be developed.
Give yourself the system that makes you to perform and hard presses you to go on working or you are liable to fall.A system wherein all the components have to perform and the non-performer is tracked immediately is the crying need in India.
Planning and management is the foremost priority of judiciary. Judges must be judicial managers, administrators, planners.
Separate Judicial management special cadre with specific law oriented management skill and people friendly planning skill and uniform judging patterns across the Indian territory be developed.
Let us start with a daily routine, to do list and targets, timetable shared with all the stake holders.Let us start with time management and ensure minute to minute productive use and investment of available judicial time (hour)

मानव जीवन अतुल्य है, प्रकृति की अनन्यतम रचना है, कृति है, प्रत्येक व्यक्ति समाज की धरोहर है। मानव जीवन जन्म से मृत्यु तक, पूरी यात्राके दौरान मानवीय गरिमा का हकदार है।
मानव जीवन की यात्रा मानव द्वारा निर्धारित नहीं की जा सकती।यह अपराध है।
यदि किन्ही परिस्थिति में ऐसा किया जाना अनुमत भी हो तो भी ऐसा तभी किया जाना चाहिये जब अन्य सारे विकल्प शेष न रह गये हो। विवशताकारी क्षणों में भी यदि समाज को यह निर्णय लेना पड़ता है तो भी समाज के लिये दुःखद है, चिन्ता का विषय है। समाज को चिन्तित तो हो ही जाना चाहिये।
मानव का जीवन अमुल्य है। उसे समाप्त करने का निर्णय कितना भी अपरिहार्य क्यों न रहा हो, विवशताकारी क्यों न हो, बुद्धिमत्तापूर्ण क्यों न हो, सामाजिक हित में क्यों न रहा हो, यह आनन्ददायी निर्णय तो हो ही नहीं सकता।
जो भी समाज अपने मानव -बध के निर्णय को न्यायोचित ठहराते हैं वे भी इस निर्णय को भारी मन से ही स्वीकारते हैं।
मैं आज किसी भी प्रकार न्याय के नाम पर भी प्रसन्न तो नहीं ही हो सकता।
न्याय के लिये यह मजबूरी में किया गया निर्णय भारी मन से स्वीकार करने के सिवा कोई विकल्प नहीं है पर इस पर मैं तालियाँ नहीं बजा सकता, हाँ शर्मिन्दा जरूर हो सकता हूँ कि मै भी उसी समाज का हिस्सा हूँ जिस समाज में मृत्युदन्ड् के अधिकारी रहते हैं, कहीं न कहीं उनके पाप के किसी हिस्से का अनजाने ही दोषी तो हम सभी समाज के लोग ही हैं कि हमारे सामने ही ऐसी स्थिति बार बार पैदा होती रहती है।
मेरी चिन्ता, शर्मिन्दगी और बढ़ जाती है जब मैं इस निर्णय पर अपने चारों और तालियों की आवाज सुनता हूँ- ---। लगा की मै हजारों साल पीछे चला गया।

The patent dishonesty of litigants has always been a real threat in the pathway of delivery of Justice.
Selfish litigants in order to serve their greed, lust often take recourse to tactical falsehood and often mix it with truth or present it to showcase the falsehood as truth in the court of law.
Such acts are being perpetrated with professional skill in a planned way.
This approach has become part of social behaviour. In order to serve self-hood and in the name of self defence it has become the traditional approach of the society to coverup truth, to cook up truth, to present cooked or mixed truth.
This makes the work of a judge very risky and breeds risk at different stages of judicial proceedings. Quite a few fall a prey to these evil designs.
In order to minimise these risks certain codified norms have been adopted by the courts and the courts try to evaluate as per those predetermined norms and conduct the proceeding through a pre-defined procedure.
These are risk management tools of the justicedelivery system.
For example the courts insist on promptness in stating the claim to the proper authority to manage the risk of additions, interpolations, development in the statement that makes the details of facts.
The courts insist that these should be written down immediately, once again a tool to manage the risk of resorting to cooked up story or the risk of ommitting the true statement of fact.

This approach has become part of social behaviour. In order to serve self-hood and in the name of self defence it has become the traditional approach of the society to coverup truth, to cook up truth, to present cooked or mixed truth.
This makes the work of a judge very risky and breeds risk at different stages of judicial proceedings. Quite a few fall a prey to these evil designs.
In order to minimise these risks certain codified norms have been adopted by the courts and the courts try to evaluate as per those predetermined norms and conduct the proceeding through a pre-defined procedure.
These are risk management tools of the justicedelivery system.
For example the courts insist on promptness in stating the claim to the proper authority to manage the risk of additions, interpolations, development in the statement that makes the details of facts.
The courts insist that these should be written down immediately, once again a tool to manage the risk of resorting to cooked up story or the risk of ommitting the true statement of fact.
Judge is the vendor of justice. In order to cater the needs of justice-seekers he blends law with wisdom in equitable proportions . A judge ensures utility and satisfaction both a point that earns maximum social acceptance. The level of social acceptability of judge's judgement is the individual efficiency of the judge and the level of legal consistency, transparency of the judgement enhances the social esteem of justice delivery system.
Trustworthiness, uniformity and reasonable predictability are the three pillars upon which a sensible justice delivery system must grow and each judge must contribute within the system to enhance these three ingredients.
