पर्दे में रहना बड़प्पन नहीं, भय की निशानी है।पवित्रता की नहीं ब्यभिचार की निशानी है। पशु, पक्षी को कभी भी किसी समय किसी आवरण की आवश्यकता नहीं होता। फूल पौधों को भी नहीं। नदी नालों  को भी नहीं।
फिर हमको और आपको क्यों ? हम क्यों अपने चारों ओर दीवार पर दीवार, प्रकोष्ठ डर प्रकोष्ठ बना लेते हैं।
न्यूक्लियर बम ताकत नहीं शुद्ध भय का परिचायक है।
यदि भय नहीं होगा तो आपको किसी आवरण की जरूरत नहीं होगी।
सबसे अधिक भय मनुष्य को अपने आप से लगता है।वह पाप करता है।और पाप का फल जानता है। विवेक और स्वार्थ, कर्तब्य और स्वार्थ, अधिकार और लोभ-स्वार्थ के घालमेल भय का कारण है, भय के कारण है।
इसी से स्ट्रेस है, तनाव है।
केवल स्वार्थ के साथ खड़े हो जाइए, स्ट्रेस से बच जाएँगे।केवल विवेक के साथ  हो कर भी स्ट्रेस से बचा जा सकता हसि। पर स्ट्रेस तब आता है जब हम आप स्वार्थ और विवेक दोनों की साधना चाहते हैं।आग और पानी को एक साथ साधना चाहते है।जमीन और आसमान को एक साथ छूना चाहते हैं। क्षितिज को आसमान और जमीन मिलने का स्थान समझ बैठते हैं। आसमान और क्षितिज वहीं मिलते है। बस उधर ही दौड़ गए।जितना मर्जी दौड़ो, क्षितिज तो दूर ही रहेगा। आसमान और पृथ्वी तो मिलते नहीं। यह तो तुम्हारा दृष्टि दोष है। उसी को आप सत्य, वास्तविकता मान बैठे हो। आसमान छोड़ दो, पृथ्वी पर अपने आप आ जाओगे। धरती छोड़ दो, आसमान पर चले जाओगे।
पर धरती, आसमान, आग, पानी, संसार और शिव सभी को साथ लेकर चलने की कोशिश ही स्ट्रेस का कारण है।
शुद्ध पवित्र हो जाओ, स्ट्रेस गायब।

मैंने दिन भर में कुछ देर के लिये बच्चों को फुटबाल खेलते देखा। कुछएक कभी कभार क्रिकेट खेलते भी अब दिख जाते है। गाँवों में ही अब ग्रामीण खेलों के प्रति चाव, आकर्षण लगभग खत्म हुआ चाहता है। बच्चों एवं किशोरों में वर्जित क्षेत्रों के प्रति एक सहज आकर्षण दिखा। वैसे यह आकर्षण शहरी किशोरों में, नवधनाढ्यों में सर्वाधिक दिखा।
देहात के इन बच्चों में मुझे इसी उम्र में ऐसे लक्षण दिखे जो निश्चित रूप से अपराध की दिशा की ओर बोध, संकेत करते हैं।
बहुत करीब से समझने की कोशिश करने पर पता चला कि उन्हें उन दिशाओं की ओर जाने से रोकने वाला, सही या गलत बताने वाला या किसी रचनात्मक काम में उलझाए रखने वाला या उनका सजग सहज मनोरंजन कटने वस्ल कोई है ही नहीं।
वे नए रेखियाते युवक यदि कुछ नया अच्छा करना भी चाहे तो कोई प्रेरणा नहीं, कोई अनुकूलता ही नहीं, और गलत करने पर कोई निषेध, विरोध, प्रतिबन्ध नहीं।
परम् स्वतंत्र न सिर पर कोउ, ऐसी स्थिति में ग्रामीण युवकों में एक निराश ब्याप्त हो ही जातो है।
ग्रामीण स्त्रियाँ या तो गम्भीर रूप से बीमार है और उनकी बीमारी का कोरे ध्यान तक करने वाला नहीं है। ग्रामीण स्त्रियाँ कठोरतम शारीरिक परिश्रम करती रहती है।वह भी लगभग बिना खाये पीये। ग्रामीण स्त्रियों के दो रूप होते हैं। अवकाश के क्षणों में पड़ोसियों से लड़ाई,दूसरा लगातार प्रजनन। ग्रामीण स्त्रियाँ लगातार पुरुषों के स्वाभाविक मनोरंजन की साधन होती है।
वैसे यह स्थिति शहरों मरण भी कमोबेश ऐसी ही है, प्रकार भेद के साथ। ग्रामीण परिवेश में मनोरंजन के साधन बहुत कम है, स्त्रियोचित मनोरंजन ज्ञान के साधन तो है ही नहीं।
भारतीय ग्रामीण परिवेश में स्त्रियों में नीरस निराशा का भाव अधिक प्रखर है। उन्हें न तो कोई सुरक्षा देता, न सम्मान, न प्रेरणा, न निषेध, न सहानुभूति। ये अपने परिवेश में तमाम प्रकार की हिंसा का लगातार शिकार होते रहती है। मैंने तमाम प्रकार की हिंसा शब्द का सजग प्रयोग विशेष कर किया है।

गाँवों में बहुतों के पास अपना रहने का घर तो पीढ़ियों से होता ही है। अनाज, मछली आदि खेत, तालाब, नदी से प्राप्त हो जाते हैं। खेत अपना अर्थात पूर्वजों का हो तो अनाज दूसरों  के परिश्रम से प्राप्त हो जायेगया और खेत अपना नहीं है तो अपने परिश्रम से प्राप्त हो जायेगा। रही बात कपड़े की तो कौन रोज रोज मेला ही घूमना है।
हो गया, रोटी-कपड़ा-मकान का निदान।
शेष बचे समय में क्या करना है, क्या हो सकता है,  कैसे करना है,, भारतीय ग्रामीण परिवेश में इसका कोई सोच ही नहीं है।
मैंने 40-45 सालों से ग्रामीण परिवेश में किशोरों को गाँवों में पेड़ों  के नीचे या तो ताश खेलते या गांजा पीते देखा, खैनी तो बड़ी सहज वृत्ति देखी।

1. भारत के ग्रामीण जीवन में जो निराश का भाव है, उसका एक कारण ग्रामीण परिवेश में साधनों का अभाव तो हो ही सकता है, परन्तु एक कारण ग्रामीण दृष्टिकोण भी है।

भारतीय सामाजिक संरचना में या तो बहुत तात्कालिक यात्राएँ की जाती है , तात्कालिक लक्ष्य निर्धारित किये जाते हैं या फिर दर्शन शास्त्रीय मुक्ति, मोक्ष आदि के लक्ष्य निर्धारित किये जाते हैं।
या तो बस रोटी, कपड़ा, मकान या फिर सीधे मोक्ष, बीच मरण कुछ नहीं।
मैनें अपने चारों और इस खाई को बड़े करीब से देखा, या तो लोग रोटी-कपड़ा-मकान पर ध्यान गड़ाए हुए रहते हैं या सीधे मुक्ति -मोक्ष पर।
देखिये, ये दोनों ही लक्ष्य अनिष्टकारी हैं।
पहला तो रोटी-कपड़ा-मकान यह थोड़े से सार्थक प्रयास से प्राप्त हो जाता है।

मैनें जीवन से यही सीखा है कि हर या जीत का यह गोरख धंधा तो अनवरत, बिना रुके चलता ही रहेगा। 

लड़ते रहिये, लड़ते रहिये और लड़ते रहिये।
आप लड़ें या न लड़ें, संघर्ष तो सदैव चलना ही है।
आप हार के डर से न लड़ें तो भी आप हार से बच नहीं सकते।
जीत तो कभी होती नहीं।
जिसे आप जीत कहते है यदि उसके बाद आपने लड़ना बन्द कर दिया तो भी हार निश्चित है। हार से बचने का एक मात्र रास्ता है - लड़ते रहिये, लड़ते रहिये और लड़ते रहिये।चलते रहिये, चलते रहिये, चलते रहिये।
जीवन में विश्राम या लक्ष्य जैसा कुछ नहीं होता।जिसे आप मंजिल कहते है वह बस एक नई यात्रा की शुरुआत भर है।
जीवन यात्रा में कोई भी मंजिल इतनी बड़ी नहीं होती कि आप विश्राम कर सकें।

मैं एक युद्ध हार गया। यह इस बात का प्रमाण नहीं है, न हो सकता है कि मैं गलत था या मेरे द्वारा किये जा रहे युद्ध का आधार गलत था।  युद्ध में मेरी जीत या हार अनेक कारकों के एक या अनेक प्रकार से एक ही समय में क्रियाशील या सक्रिय या निष्क्रीय होने के संयोग पर निर्भर करती है।
यदि जीवन एक सतत चलने वाली प्रक्रिया है तो संघर्ष भी समानान्तर चलने वाली प्रक्रिया।
हार या जीत, दोनों ही शब्दों से मुझे चिढ़ सी है।
अपनी हार से उतना मत चिढिये जितना कि अपनी जीत से।
आपकी जीत में किसी की हार छिपी होगी। किसी की भी हार आप की हार या जीत से कम  या भिन्न तो नहीं ही होगी।

देखिये, एक बात स्पष्ट है कि दुश्मन के साथ रहने, लड़ने, उसके स्मरण से किसी न किसी प्रकार आपमें दुश्मन के संस्कार तो आते ही हैं।
दुश्मन हार भी जाये तो भी वह अपने पीछे अपनी सम्पत्ति, अपना घर मकान और अपनी यादें तो छोड़ ही जाता है। यह सब सामान विजय प्राप्त करने वाला उपयोग में लाता ही है। पराजित पक्ष का धन जन विजयी पक्ष भोग करता है। इसी प्रकार पराजित दुश्मन के संस्कार होते है। पराजित पक्ष के संस्कारों का परभव विजयी पक्ष पर पड़ता ही है।
आपका दुश्मन ,दुश्मन इसलिये नहीं है कि वह आपसे बुरा है और आप उससे अच्छे। दुश्मनी का कारण स्वार्थ का टकराव है।
चोर की दुश्मनी पुलिस से इसलिये है क्यों कि पुलिस चोर को चोरी करने से रोकने का प्रयास करती है।चोर पुलिस से बैर रखता है। इससे चोर शुद्ध नहीं हो जाता।
अनेक विचार, अनेक समस्याएँ, अनेक देश, अनेक समूह, दूसरे विचार, दूसरे देश, दूसरी सभ्यता अथवा दूसरे समूह,परस्पर लड़ते झगड़ते रहते हैं। वैमनस्य रखते हैं। दुश्मनी रखते हैं।
पर यह दो विचारों, सभ्यताओं, दो समूहों में पारस्परिक दुश्मनी  या प्रतिस्पर्धा किसी एक कि श्रेष्ठता का प्रमाण नहीं है।
युद्ध का परिणाम भी युद्ध के कारणों का औचित्य सिद्ध नहीं कर सकते। कोर्ट - कचहरियों में मुकदमें जीत जाने से या हार जाने से पक्षकार का औचित्य सिद्ध नहीं किया जा सकता। हर ब्यक्ति की प्रतिरोध शक्ति अलग होती है, मात्रा, प्रकार औऱ प्रकृति में।
हर या जीत का सम्बंध इसी आंतरिक और वाह्य प्रतिरोध शक्ति पर निर्भर होती है।विरोध भी पसंद नापसन्द पर अधिक आधारित है। न कि औचित्य या अनौचित्य पर।

कम से कम अपनों के बीच तो परस्पर सम्मान, एकता, मित्रभाव, सहयोगी भाव पैदा कीजिये।

अपनो के प्रति भेद भाव, शोषण की ,घृणा की प्रवृत्ति को दूर कर पाना आपके लिये पूरी तरह सम्भव है।

Yes, I attended a session on "wisdom behind Law and Constitution.
 Am I feeling good? 
Yes, I am.

🤔 A very sad joke about lawyers and need to standardise their minimum fees : Someone sent me a joke about lawyers on WhatsApp. As per joke, once there was a water problem in house of a lawyer. He called plumber. The plumber checked pipeline and water started in pipeline. Then he asked for his labour charges Rs.400/-. The lawyer exclaimed, "For one hour work, how can you charge Rs. 400/-. I am a lawyer. I work whole day and still I have difficulty in earning Rs. 400/- per day !!! Plumber relplied," Precisely. That is why I gave up advocacy and became a plumber." The joke did not make me laugh. It made me sad. I wonder when standarisation of fees of lawyers will take place in India.

 This song is so apt in every situation of life.
 Whether you love your wife or girlfriend, job or business, interest or passion, you should LOVE IT AND GIVE YOUR 100%, because it is not a deal or transaction. If you are expecting the same reciprocation in lieu of your efforts, you are not loving her or that work or passion. This might seem spiritual or intellectual, but it aptly fits in all aspects of the life. We often pursue something or like someone, and begin expecting them also to like us in the same way. If it doesn't happen, the passion or interest reduces, and diminishes gradually. 
 If you are a writer reading this, fall in love with your writing. 
Feel that she is like your partner in crime who loves you eternally. 
 When you begin feeling it without expecting, you would write naturally, and do justice to yourself and your feelings. 
 Remember, if you are expecting a positive result or the same reciprocation, you are not doing a justice to your efforts, passion and love.

How to prepare or argue in land acquisition appeals - All such appeals contain bulk of papers, about 5 Kgs to 10kgs. From where to start reading and what to read is often a problems for young advocates who may not have previously dealt with such appeals. Try to look for answer of the following questions which a judge may ask you. 1) What is the name of scheme for which land was acquired? 2) How much land was acquired? How much land is involved in these appeals? 3) What is the date of Sec. 4 Notification? 4) What is the date of Sec. 6 notification? 5) What is date of Award? 6) What rates were offered by the Collector? 7) What rates are given by Reference Court? 8) What rates are given by High Court? 9) Which method was used for evaluation of market value of land? These are the minimum basic facts which a judge may want to know before hearing you in detail. Once writing down these basic fact, try to read relevant caselaws and then see if any of the case is applicable in present appeals.

Jurists are not born. They are cast in dyes at Bar and finished, sharpshaped at bar after friction through Public Expectations.

Any hate for bar can never make a good judge.
Any contempt for litigant makes a judge a ruffian.
Any deviation from law makes a dirty judge.

Bar means Cumulative image of all the advocates together

Every judge must be trained to make most efficient use of Bar Forces in his journey towards Justice.

Advocates and We the people have the knack, tradition, authority, social sanction, perhaps legal sanction to some extent to do so because they earn the benifit of doubt.
A judge pays heavily if doubt hovers around him.
No judge can claim benifit of doubt.
Judge must be above any shadow of doubt.

The issue of language ( english or hindi ) is not that this language-apartheid entered the Constitution.

Sir we have to think practically, the worst practise is followed by Senior Counsel who make money in lakhs and pay nothing or pay in peanuts and pennies to a junior who has passed his law after 5 years spending 5-15lakhs minimum. The manner in which senior lawyer operate is similar to a "cartel" which is the biggest reason for not doing litigation. And another hindrance is this notion of 'historical oppression' meaning, because i suffered for years you also should go through the same. Afterall sir education bills and rent cannot be paid with exposure you need some amount of decent money. And the kind of money senior advocate and counsel make, it is possible

At the real execution site, I often learned most from the boy cleaning the floor, manning the door, managing the nitty gritty or the initials .
He was so small that he could see where I could not.
And anyway,  the real operational profession is one where one starts to learn the day one starts his journey with his dream.
And the learning never ends.
Forget seniors.
Start out on your own.
It will be tough but it will be worth it.
No one gives a damn in whose institution, office, establishment you were. They want results; WINS, PROFITS,  in short.

In a proud moment for police constable Janardhan Singh, his son Anoop Singh has been posted as the Superintendent of Police (North) in Lucknow, a city where he himself is posted. He will work under the leadership of his son.

Anoop Singh took charge of the city on Sunday. His father is posted at the Vibhuti Khand police station.

When asked about his son's achievement, Janardhan Singh couldn't hide his feelings. Elated with the development, he said he was feeling proud and it would be good to work under him. "I feel proud to have my son as my senior. It's an honour for me. It feels good to work under him," he said.

Janardhan Singh said as per the protocol, he would salute his son whenever he meets him on duty.

A junior with knowledge of stenography reduces 90 % of burden from a senior's shoulders. A senior only has to focus on research and development of good arguments rest the junior can take care. Now a days juniors with good typing speed and command over hindi and English language are preferred by seniors. So I believe chances are great

परन्तु जिनका यहाँ कोई जनाधार नहीं है वो भी यहाँ दौड़े आएँगे तो क्यों? बेगानी शादी में अब्दुल्ला दीवाना क्यों हो जाता है? समस्या की जड़ यहीं है। 

यह देश इसी राजनीतिक दोगलेपन का शिकार होकर बरबाद हो रहा है और अधिसंख्य आबादी का इससे कोई सरोकार नहीं है। नेता, अधिकारी, व्यापारी व आम जनता सभी को बस अपने हित नज़र आते हैं।

तो ऐसे में क्या कहें इनको? कहने को कुछ कहिए परन्तु सच्चाई तो बदलने वाली है नहीं और सच्चाई यही है कि आज सभी देश के लिए घातक बन चुके हैं। सभी के अपने स्वार्थ देशहित से ऊपर आ चुके हैं। यही सर्वाधिक दुखद है। यहाँ किसी के समर्थन या विरोध की बात नहीं है। बस बात है उस सच्चाई को समझने की जिसको जानते हुए भी हम नजरअंदाज करते हैं और देश के साथ, अगर कहूँ कि गद्दारी करते हैं, तो यह गलत नहीं होगा। यह बात जानने व मानने के बावजूद हम यदि अकर्मण्यता की स्थिति में हैं तो यह धोखा है देश के साथ। यह बात हम जितनी जल्द समझ ले उतना ही बेहतर होगा। परन्तु हमारे स्वार्थ ऐसा होने देंगे, मुझे शक है।

क्षेत्रीय पार्टियां अल्पमत लेकर सत्ता पर काबिज भी हो रही हैं जिनके पास ना विस्तृत सोच है ना बड़ा क्षेत्र है। और ना ही आगे बढ़ने की संभावनाएं ही रह जाएंगी 

दूसरों कि एक आंख फोड़ने के चक्कर में हम अपनी दोनों आंखें फोड़ ले तात्पर्य यह है कि मोदी को रोकने के लिए अन्य राजनीतिक दलों का अस्तित्व खत्म करने पर क्यों तो तुले हैं । हमें एक बहुत अच्छी चीज सिखाई जाती है कि दूसरों को छोटा करने के लिए उससे बड़ा बनकर दिखाओ लेकिन यहां बड़ा बनने की कोशिश नहीं की जा रही है यहां कई छोटो छोटो को खत्म करने की कोशिश की जा रही है

Why a society like us "'We The People " of India cannot manage the intellectual Property  of our own people or whether our 120+ crores minds do not work at all or worked rarely in the last two centuries or so. Why we are having such a poor inventory of Intellectual property at our command. Intellectual property or call inventions are not always product of very huge investment of resources or time. At times it has come accidently, through intuitions, through mistakes or through only a bit applied presence of mind, small imaginative thinking,petty experimental entrepreneurship.

Intellectual property though present but not identified or not taken into inventory is lost property.
We do not recognise our IP or we fail to locate it .We have failed to secure our IP. We either intentionally or inadvertently do that. Otherwise either we have not been trained on those counts or we have not been sensitised enough.

Any nation who fails to safeguard its wealth, cannot survive . Every sovereign state has a duty to protect its geographical boundries, National wealth- both corporeal as well incorporeal. The foremost wealth and resource of a state is its subjects- human resource. A state is duty bound to invest vigorously in the development and upliftment of its human resources. Intellectual property is the product of mental exercise, thinking process, imagination, intuition, experiments by men.

Every state has to keep a watch over the national wealth and must ensure its safety. A systematic upkeeping of  national worth is must I sincerely call upon the national think tank of India to moot, propose, explore the establishment of "Intellectual Property Management Authority Of India." with the following objectives-
a) TO create a ground -base data bank of all Intellectual Property like objects, propositions, innovations, ideas whether still finally established or still unrecognized or not. This should be spread up to Gram Panchayat Leveland can be manned at village level by IP Identifier Volunteer Force.

b) To establish Technical Laboratories  in order to cater to the needs of small IP Entrepreneur and to assist the other IP activists

c)To establish Legal Laboratories  as well service centers to help small IP Entrepreneur and to assist the other IP activists

d) To establish a Legal Action front equipped with world class IP law knowledge with very sound Technocrat professional Force to assist Indian  small IP Entrepreneur and to assist the other IP activists in courts

e) To establish an IP management fund structure to be utilised exclusively for creating, managing, docketing, locating IP worth of India.establishing IP base clinics at village level, IP referral Centers at District Level and state level IP management Center and Central IP management  center, data Bank and utility Center- Authority. To build infrastructure for IP Procedure Code  and developing the norms for the same .

f) To establish an IP Litigation and Protection Fund to be utilised to create awareness about IP, IP-laws,IP Concept, IP protection and confidentiality,Ip transaction, , IP legal procedure, IP Education, Inclusion of IP importance in school curriculum, for supplementing and raising effective court-resource persons as well for raising IP Volunteers Force, equipping Indian Law campuses
and Technical Institutions with IP knowledge infrastructure. And to create an independent IP PROTECTION BODY and to carry IP procedure code.
 g)To raise an Indian Data Bank exclusively for IP purpose.

Since so much rests on such a short window of time to get an SLP admitted, it’s easy to see why senior advocates are so expensive and why many clients appear happy to pay those rates

CORRUPTION.

Alok Pandey  is right in his answer that policy paralysis was the cause of economic down turn, but it was corruption in the corridors of power which was the root cause of  this policy paralysis.

If we consider the global economic scenario during the UPA-II reign in India- burgeoning oil prices going through the roof, the financial crisis and the great depression in the biggest economy in the world, the Euro zone crisis, the series of political turmoil in Iran,Syria and Ukraine - we can even consider that the Government did reasonably well to keep Indian economy insulated from the after shock of all these debilitating developments. Indian economy continued to grow, and income levels kept increasing, though the fiscal and current account deficits started causing concern and inflation started rearing its ugly head.

The actual downturn started by mid-2010, when scandal after scandal like 2-G Spectrum allocation, Asian Games, allocation of coal blocks etc etc, started bursting upon the unsuspecting Indian polity one after another with bewildering frequency. This lead to a crisis of credibility of the government, and  caused a disconnect between the Government and the autonomous institutions like Reserve Bank of India, the Higher Judiciary and the Comptroller and Auditor General (CAG) who started closely scrutinizing and questioning each and every action of the Government.The Prime Minister and the other cabinet ministers had to expend all their energies in containing the damage caused by these wave of  corruption charges, they were left with little or no energy for any affirmative action to  focus on economic growth and development.

This loss of moral face by the government also emboldened the opposition both inside and outside Parliament to disrupt whatever feeble moves the embattled government made from time to time to stem the rot or push for some reforms.With the General elections looming large over the horizon, and the prospect of a near certain electoral defeat staring them in the face, the government, and with it,the domestic economy, started resembling a sick man in the throes of his death bed

This is how the corruption caused policy paralysis, leading to total lack of either preventive measures or pro active actions from the government, and the economic downturn was the inevitable fall out of this loss of governmental authority and credibility.
