PATNA: International Finance Corporation (IFC), a member of the World Bank group, on Saturday organized a workshop here on effective tax dispute resolution mechanism, in association with Commercial Taxes Bar Association, Bihar.

At the workshop, 15 specialists, including members of judiciary, senior advocates and officials of the commercial taxes department, presented the benefits of tax appeal reforms and the mechanisms to effectively resolve tax dispute under the simplified value added tax laws.
Rajul Awasthi, a senior tax specialist, IFC, said, "IFC's global experience in accelerating and facilitating reforms has helped reduce the time and financial cost that businesses incur in complying with tax rules, thus encouraging them to join the formal economy and widening the tax base."
Justice Vineet Kothari of Rajasthan high court spoke on trends in VAT disputes in India and suggested the measures to be taken to resolve them.

Ramesh Kumar Rateria, chairman, Commercial Tax Tribunal, Biharshared his views on the lessons learnt and way forward towards an effective tax dispute resolution mechanism.

Based on IFC's recommendation, the government of Bihar has adopted several measures such as a flat rate of tax for micro and small enterprises, e-governance regime for large enterprises, simplifying admission of appeals, fast-tracking resolutions, and issuance of refunds. The government of Bihar has also changed the existing law on tax appeal to exclude the penalty amount from the disputed tax amount, bringing relief to firms lodging an appeal.

Standard services are the only expectation of all and every citizen. This standard service must flow from all sources- even from a state source. State must not ill serve its citizens. Sub-standard services at all level must be challenged , resisted.Every law must yield the standard expected output for the society. If law mandates services to the citizen , it must be provided. State cannot litigate without due compliance of all laws and ensuring at least due services as per law. Laws must bind the state as well until the same are changed.
State functions cannot be taken as merely monetary or financial activities or for the purposes of generating idle state jobs without real effective , standard , services to citizen.
Feeding the citizen with compulsive sub-standard services is draconian. If the judiciary colludes with state executive in this substandard dispensation of services, it will be disastrous, inhumane.

They know the art of deciding ratio and proportion of adulteration and further know how to change the decisions as per their convenience , whims or interest,
whereas it has been i pure purity for me all along my life from day one.

दरभंगा, नसं : जिला विधिक सेवा प्राधिकार के तत्वावधान में लहेरियासराय स्थित कमला नेहरू पुस्तकालय में पारालीगल वोलन्टियर्स का दो दिवसीय प्रशिक्षण शिविर शनिवार को शुरू हुआ। इसका उद्घाटन करते हुए जिला एवं सत्र न्यायाधीश सह अध्यक्ष जिला विधिक सेवा प्राधिकार आरके रटेरिया ने कहा कि इस प्रशिक्षण में कानूनी एवं न्याय संबंधी जानकारी दी जाएगी। इसके माध्यम से समाज में कानून व्यवस्था एवं शांति बनाये रखने के लिए काम करना होगा। पुलिस एवं आम जनता के बीच संबंध की मजबूती पर बल देते हुए उन्होंने कहा कि पुलिस समाज में शांति व्यवस्था बनाये रखने के लिए ही काम करती है। इस कार्यक्रम में जिला व सत्र न्यायाधीश रतेरिया ने कहा कि जनोपयोगी कानूनों की जानकारी आम आदमी तक पहुंचाना जरूरी है। यहां जिन कानूनों की जानकारी मिलती है उसका उपयोग समाज के बीच करना है। कोई समस्या सामने आये तो इसका निराकरण विधिक सेवा प्राधिकार के सचिव से संपर्क कर किया जा सकता है। उन्होंने कहा कि पारा लीगल वोलेन्टियर का काम समाज एवं कानून के बीच सेतु का है।

विधिक सेवा प्राधिकार के सचिव सह एनसीजेएम राजीव रंजन ने कहा कि इस प्रशिक्षण में कुशेश्वरस्थान पूर्वी एवं हायाघाट प्रखंडों के 44 पारा लीगल वोलेंटियर्स भाग ले रहे हैं। इन्हें प्रत्येक पंचायत में प्रतिनियुक्त किया जाएगा और एक दिन का मानदेय 500 रुपये दिया जाएगा। इन्हें पहचान पत्र भी दिया जाएगा। यह व्यवस्था तत्काल एक वर्ष के लिए की गई है। इस अवसर पर अधिवक्ता सियाराम यादव एवं डीपी पारिजात ने भी कानून संबंधी जानकारी दी।

सेमिनार के दूसरे सत्र का उदघाटन वरिष्ठ पत्रकार इन्दुभूषण पांडेय ने दीप प्रज्जवलित कर दिया। श्री पांडेय ने कहा कि मध्यस्थता के माध्यम से मामलों का निष्पादन करना आसान होगा। इसके लिए न्यायालय दौड़ने की जरूरत नहीं पड़ेगी। इस कार्यक्रम की अध्यक्षता जिला एवं सत्र न्यायाधीश आरके रटेरिया ने की। कार्यक्रम का संचालन लॉ कालेज की छात्रा स्थिति ने किया। इस सत्र में भी बार एसोसिएशन के महासचिव इंद्रशेखर मिश्र, सियाराम यादव, सीजेएम पीके दीक्षित, एडीजे पीडी गुप्ता आदि ने विचार व्यक्त करते हुए कहा कि मध्यस्थता समाज को मुकदमों के बोझ से मुक्ति दिलाने का आसान उपाय है। आगत अतिथियों का स्वागत एवं धन्यवाद ज्ञापन एसीजेएम राजीव रंजन ने किया। श्री रंजन ने कहा कि पति पत्‍‌नी के बीच झगड़ा, जमीनी विवाद को मध्यस्तता के माध्यम से निपटाया जा सकता है। इस संबंध में विस्तृत प्रशिक्षण दिया जाएगा। इसका उपयोग पारा रीगल वोलेन्टियर्स अपने अपने पंचायत में करेंगे। दूसरे सत्र को संबोधित करते जिला एवं सत्र न्यायाधीश श्री रतेरिया ने कहा कि बात-बात में न्यायालय जाना महामारी बन गई है। जब पोलियो जैसी बीमारी दूर की जा सकती है तो इस महामारी को स्वयंसेवकों के माध्यम से क्यों नहीं समाप्त किया जा सकता। जरूरत है उत्साह एवं लगन से काम करने की।

My silly little mistakes were my all time greatest teachers . I stammered ,slipped , fell, but mustered courage, corrected ,rose , marched and will walk far,farther, farthest.
