Yes that is true. You may not be acknowledged earlier. You yourself may not believe it earlier.
But ten years alone will not make you that stuff.
Painstaking training , very hard work , endurance up to the core , learning , writing , listening and convincing are further requisites.
And ultimately you will have to create opportunities for yourself.
Creating that , grabbing that , retaining that and delivering that for ten years---now you can be called that stuff.

अंदरखाने के कुछ खेल बिना रोक टोक - बिना हिचक चलते रहते है - सारे बड़े लोग जो पूरे देश में कुछ हजार होंगे ,परस्पर एक दुसरे का ख्याल रखते है , अधिकांश तो बोल कर ही यह सुनिश्चित कर लेते है - उन्हें विश्वास है -कह दिया है बस हो ही जायेगा . आप मेरा कहा कीजिये मैं आपका कहा करूंगा . योग्यता नहीं , यही कहा -कहवाया ही उपर काम आता है .
वैसे देखा देखी यह नीचे भी हो रहा है .
योग्यता लगभग अधम हो कर रह गयी है . अब तो यह निर्लज्ज भाव से सुस्पष्ट हो चला है .
या तो अपना होना , अथवा किसी का हो जाना - कहना - कहवाना ही अंततः प्रभावी होता है
कभी कभार बिल्ली के भाग से छिका टूट जाये सो अलग बात है .

यह पाप तो सभी करते आ रहे हैं , लगभग खुले आम , फिर खुले आम अश्लील शब्दावली का धड़ल्ले से उपयोग ,खीस निपोरते हुए बेशर्मी से झेंपने का नाटक - बस यही विश्वास रहता है कि ये बातें आम नहीं होगी , यदि होगी भी तो सभी मिल कर दबा देंगें , मुँह नहीं खोलेगा -- कोई कोशिश भी करेगा तो खोलने नहीं देंगें - मुँह बन्द करवा कर रखना ,मुँह नहीं खोलने देना - यह पाप तो धड़ल्ले से बिना किसी संकोच के होते ही आया है .
पर अब बंद हो जाना चाहिये ,यह जघन्य अमानवीय हैवानीयत भरा कृत्य.

अपने मन की ही करने वाले - चमड़े का सिक्का चलने वाले , दिल्ली से दौलताबाद और फिर दौलताबाद से दिल्ली करने वाले बहुत सी संस्थाओं के शिखर पर आज भी बैठे हैं - शायद भविष्य में भी यह क्रम चलता रहेगा .
यह धरती ऐसे मद-वीरों से कभी खाली नहीं होगी .
समाज यहाँ वहाँ टुकड़ों में कभी कभार मिल बैठ कर रो धो लेगा , निन्दा कर देगा --- बस इतना ही .

Are not we fit to be discharged from the OT and shifted at least to a ward ?

Had we been really enthusiastic about our compliances ,had not skipped them knowingly, the health of our nation and country would have been much healthier. We are a country of non compliers. We earn through skipping compliances. We wait till we are asked and grilled to explain. We still treat state as our enemy.We do not share state concerns or collective concerns rather we take pride in violating state norms . Our experts are always busy trying another trick to advise the ways to avoid compliance -the extra legal way.We must grow ourselves as law friendly society. It is very very late.

In view of the above discussions, we hold the confessions of the accused in the present case to be voluntarily and validly made and under Section 15 of TADA confession of an accused is admissible against co-accused as a substantive evidence. Substantive evidence, however, does not necessarily means substantial evidence. It is the quality of evidence that matters. As to what value is to be attached to a confession will fall within the domain of appreciation of evidence. As a matter of prudence court may look for some corroboration if confession is to be used against a co-accused though that will again be with the sphere of appraisal of evidence.
In Hari Charan Kurmi and Jogia Hajam vs. State of Bihar (1964 (2) SCR 623) this Court again relied on its earlier decision in Kashmira Singh's case and on the decision of the Privy Council in Bhuboni Sahu's case. It said that technically construed, definition of evidence as contained in Section 3 of the Evidence Act will not apply to confession. Even so, Section 30 provides that a confession may be taken into consideration not only against its maker, but also against a co-accused person; that is to say, though such a confession may not be evidence as strictly defined by Section 3 of the Act, it is an element which may be taken into consideration by the criminal court and in that sense, it may be described as evidence in a non-technical way. But it is significant that like other evidence which is produced before the Court, it is not obligatory on the court to take the confession into account.
.From the plain language of Section 164 CrPC and the rules and guidelines framed by the High Court regarding the recording of confessional statements of an accused under Section 164 CrPC, it is manifest that the said provisions emphasis an inquiry by the Magistrate to ascertain the voluntary nature of the confession. This inquiry appears to be the most significant and an important part of the duty of the Magistrate recording the confessional statement of an accused under Section 164 CrPC. The failure of the Magistrate to put such questions from which he could ascertain the voluntary nature of the confession detracts so materially from the evidentiary value of the confession of an accused that it would not be safe to act upon the same. Full and adequate compliance not merely in form but in essence with the provisions of Section 164 CrPC and the rules framed by the High Court is imperative and its non- compliance goes to the root of the Magistrate's jurisdiction to record the confession and renders the confession unworthy of credence. Before proceeding to record the confessional statement, a searching enquiry must be made from the accused as to the custody from which he was produced and the treatment he had been receiving in such custody in order to ensure that there is no scope for doubt of any sort of extraneous influence proceeding from a source interested in the prosecution still lurking in the mind of an accused. In case the Magistrate discovers on such enquiry that there is ground for such supposition he should give the accused sufficient time for reflection before he is asked to make his statement and should assure himself that during the time of reflection, he is completely out of police influence. An accused should particularly be asked the reason why he wants to make a statement which would surely go against his self- interest in course of the trial, even if he contrives subsequently to retract the confession. Besides administering the caution, warning specifically provided for in the first part of sub-section (2) of Section 164 namely, that the accused is not bound to make a statement and that if he makes one it may be used against him as evidence in relation to his complicity in the offence at the trial, that is to follow, he should also, in plain language, be assured of protection from any sort of apprehended torture or pressure from such extraneous agents as the police or the like in case he declines to make a statement and be given the assurance that even if he declined to make the confession, he shall not be remanded to police custody.

जब पीढ़ियाँ साथ मिल बैठती है तो एहसास बदल जाते हैं , नजर ही बदल जाती है , फितरत बदल जाती है ,हसरत बदल जाती है -- जाने वाला सब कुछ दे जाने को उतावला सा हो उठता है , आने वाला जाने वाले को आश्चर्य से देखता है ,जाने की तो नहीं पर इतना चला जा सका यह सोचता ही रह जाता है और फिर अपने नन्हे प्पंवों की और देख मन ही मन डर सा जाता है ,संकोच से भर सा जाता है -- जाने वाल आश्वस्त कर कर ही जाना चाहता है --और जो है वह अभी कर ही रहा है -उसे डर है जाने वाला जाते जाते भी कहीं हिसाब न मांग बैठें और उसे आने वाले के लिये भी तो कुछ कहना है , करना है .
पीढ़ियों को मिलते जुलते रहना चाहिये .सहारा बनते , लेते-देते ,साथ साथ चलना चाहिये . पुराने को खुद को बोझ बन लड़ने ,लादने , लदने ,लदवाने से बचना चाहिये .
