Only IP entrepreneur knows the entire teething pain, the other odds and lastly how SC is going to decide. Of course investment, confidentiality and ultimate risk factors are always there. We have in India few IP savvy brains, fewer technocrats, still fewer professionals and hardly any one in legal field , none in judiciary. But the new generation will fight against status quoist mind set. No more only defensive attitude, no more protectionist mind set, let there be a healthy competition- in the long run India will gain provided we encourage our young imaginative minds.

A few decades ago we as a society resisted Trade marks and copy-rights, still to-day we do not think high of those who assert their Trade-Mark -Rights or Copy -Rights and courts or police in India do not come promptly to control the infringements of these rights- even to-day those who assert their rights as a writer, composer, singer etc are not taken in healthy esteem- We have never encouraged IP... creators nor do we provide stimulant for IP entrepreneur- to know IP law is one thing, to fight tooth and nail for IP awareness is different. We do not have Indian IP Vision For next 50 years. We fail to understand that IP law is not mere law but IP declaring factory, recognising mechanism and an independent production process that can independently contribute to GDP of the nation

Property Jurisprudence in India

We intentionally enact protectionist laws and gag the innovative instinct-we fail to channelise our intellectual strength- our industry houses would prefer to invest in order to innovate ways to avoid law ,avoid tax and cannot invest even if minds beg for that, in creating individual or corporate IP, we are best in the world to kill inquisitiveness , questioning minds, improving hands and are market leader for every thing worn out, stale, obsolete- we purchase scraps and deal in everything second hand, we as a nation are in the world market either beggingly or by courtesy - Our legal brain has no idea of Property Jurisprudence- may be we are still beginners .

पाप क्या है, शायद हम सब नहीं जानते, पर हम सारे भारतीय स्वतंत्रता आन्दोलन में ही सिखाये गये थे कि सरकारी टैक्स, संम्पत्ति की चोरी पाप नहीं है, और आज भी उस ग्यान को,उसी बात का अक्षरशः पालन कर रहै हैं----यदि कोइ नहीं करता दिखता है तो सारा परिवार, महल्ला उसकी खिल्ली उड़ाता है, साथी रिश्तेदार झक्की-शक्की कहते है----- अंग्रेजौं के जमाने में हमारे नेताओं ने हमें सरकार के प्रति अवग्या सिखाई थी, आज भी हम उसी पर कायम हैं, सरकारी काम निष्ठा से करने वाले अधिकारी उपहास के पात्र बन जाते हैं, समज उनके साथ खड़ा नहीं होता।

If you are with them , you must cater to their greed, lust and fanciful interest. "

We proved that we are basically IP market or IP consumer and not at all interested in IP creation, production or improvement.
If one (1) and Two (2) are distinguishable and are definitely different numbers , how you are confused in between 100000( one lakh) and 100001 (one lakh and one) , only proportion confused you all.
It takes a larger investment of time ,mind, resources, intuition to make ev...en the slightest improvements after a certain degree of development and only these last cutting edge improvements create the winning IPs but then only learned specialists can differentiate between the two, not everybody and never ordinary minds.
Let us hope better conducive climates for IP entrepreneurs - not for now at least.

If we take and we have taken and succeeded in getting the concept of Intellectual property formalised to a great extent.then we will have to concede that every property has to pass through a production process- utility creation process, securing it process, processing it process. Like all the manufacturing processes Ip Production creation must have more or less same or similar entrepreneurial haza...rds.
Similarly the process may have to be abandoned mid-way. The entrepreneurial activity carries other commercial,moral, sharing, apportionment, quantifying, inter-se interest-conflict,entry of new entrepreneurs, exit of entrepreneur for various reasons. Successful IP activity is always welcome but as an society we must be ready for unsuccessful IP adventure. Now the once unsuccessful Ip adventure may further be continued either this way or that way. Some time a very rewarding IP adventure may has to be stooped for some time for want of financial resources, natural calamities, health risk of one or some components, for political reasons or some IP established may not be understandable to the contemporary society and may come to be established at a late point of time


We must take into account all these dimensions of IP. Ip is peoples worth,wealth and the state and world community has a duty to recognise IP right of every human basic feature of human independence,human right and human property.

पत्तियो से फाख्तों के ही घर नही बनते
मेरे जैसे इन्सान भी यहाँ पीढ़ियाँ गुजार देते हैं
ये पत्तियाँ केवल जानवरों की ही नहीं
मेरे जैसे इन्सान भी इन्हीं से पीढ़ियाँ पाल लेते हैं।

क्यों नहीं मैं पाप करना सीख पाया
झूठ फरेब क्यों नहीं मुझे भाया
नंगापन मेरा अपना था,
भूख से पिचका पेट भी मेरा था
पत्तों से तन ढकता मै था
पत्ते खा , खिला जी देने वाला मै था
पर इन सब की तिजारत करना,
इनकी भी नुमाइश हो सकती है,
यह सब तो स्टडी मैटेरियल हे
य़ह सब क्यों नहीं जान पाया मैं।

या कि तुम्ही हो इन सबके के सुत्रधार
न जनाया, न जानने दिया
केवल मुझसे खेला
नचाया खूब मुझे
फोटू भी खुब खैची गई
शैलानी गाडियोँ में लाये गये थे
बस मै मजबूरियों को झेलता रहा
तुम मैरे नंगे पन की बेशर्म नुमाइश करते रहे।
